what to do about ebay winning bidder not paying?

I had an auction for a palm 3xe on ebay and the winning bidder answered only one email and has ignored the rest. It's been like two weeks? Am I SOL?

no, click on safe harbour, have ebay send them an email, then wait 7 days, if no go then request a payment refund from ebay and give negative feedback.

I'm waiting until day 89 to leave the person that won't pay for the auction they won. There's this guy who already gave me positive feedback and he's a nice guy and he swears I forgot to send 2 things (even though I'm sure I included them in the package). The things are worth much and I told him that I could give him double what I *supposidly* forgot to ship for a small price. He agreed on that deal, and I became $7.00 richer
