SELLERS!!!
here is the story... my car got hit so i have decided that no matter what happens with insurance, i would like to replace it. for the past few days, i have been hitting up the usual sources: autotrader.com, cars.com, nj.com, and ebay motors. after some monitoring, i had my eyes on this accord and sniped it with a vengence. score, right? wrong.
immediately after the auction ended, i emailed the seller the following:
hello,
i will be gathering the neccessary fund and would like to pick up on either tues or wed (depending on which day i am able to get a buddy to come down with me to do the pick up). i will be completing this transaction in cash. i will be in contact with you as further details unfold. should you need to contact me for any reason, i can be reach at this email address, or by my cell (xxx) xxx-xxxx. thank you.
so all was fine in spankyland, until tonite at 9:50pm. after eating dinner and showering, i come to my room for the usual wasting of time on the net session. i logged into my email and see that i had a messege from the seller. i thought it was cool, as i was excited to hear from him and see what he had to say. here is what he wrote:
Hank
I just left you a message on your cell phone a few minutes back. The car is not available for sale anymore due to an issue with my other car. My car broke down this morning and now if this one is gone I will be left without one. Pls try and understand. Call me at xxx xxx xxxx and we can take it from there. Sorry for the inconvenience caused.
WTF?!?! i don't believe that for a god damn second. i am convinced that even tho he was the dumbass who set his reserve at $2300, he decided he wants more $. what the f(you)ck!??! i had my heart set on that car and he pulls out AFTER the auctions ends???!?!
at this point, is there anything i can do? i know that many ebay sellers have a lot of mumbo jumbo in their auction descriptions with something along the lines of this "by bidding/winning this auction, you are entering a legal contract... yatta yatta yatta... (insert legal threat here)". is there something like that for buyers??? i'm guessing no, since ebay makes money off sellers, and in my case, they already made $80 of this seller & $0 from me. any advice as to what i can/should do? man, i am so pissed right now.

Hello, I had this car on my watch list and was not home in time to bid. I see that the reserve was met and the car has sold. I just wanted to ask you... if the buyer happens to back out, would you please let me know... if you relist it, or list it locally, I am also in NJ and would really be interested in this car. Thanks so much!

He's probably legally obligated to sell it to you at the winning bid. This is a contract, and he agreed to it by submitting the auction. Contact a lawyer.

Spanky, if KarenMarie gets the kind of response you're looking for, don't contact the seller about it before you speak with a lawyer first.

You can tell him you're real sorry about his situation (yeah, lies, all lies), but you feel he is obligated to sell you the car. Don't threaten him with Ebay, or legal, action yet. Try to get the situation resolved in a polite manner. Let him weasel a bit. Then sue his fvckin' ass.
Edit: You may not need a lawyer. $3,000 is the maximum limit in New Jersey for small claims court, and you're falling under it. Call the city and ask what you need to do to file a claim. I know in Memphis, it was ~ $75 to file a claim in small claims court.

i replied to his email. it goes something like this:

sorry i missed your call. i was at dinner, then showered. i came back to my room with this disappointing email waiting for me. i have yet to check my voicemail tho. i was afraid that this might be a little late to call, so i am emailing you instead. when you get your other car fixed, can we complete the transaction then? i really had my hearts set on the car since i first saw the auction. i have an affinity for the 4th gen accords and yours just swept me away. please let me know, as i would really like to work this out. thanx.
sometime after work, aug 1
i called vik (the "seller") and asked him whats up with the car. basically the conversation went something like this:
me: sup with the car?
vik: sorry man, i can't sell it becuz my main car died today
me: oh sorry to hear that. maybe we can work something out.
vik: i dunno man, i brought my car into the shop and i's going to cost a grand to fix it. i'm gonna need some time to get the money for it, maybe like two weeks. i don't want to keep you waiting.
me: it's cool, i don't mind waiting for your car to get fixed.
vik: yeah, but i am not sure how long it will take for me to get the money.
me: dude, i have twenty five hundred dollars with your name on it.
vik: well the thing is, i am not sure if i want to get it fixed. the trans blew up on me and you know, once the trans goes, who knows what else is next.
me: i see....
vik: sorry man, it just died on me this morning. when i got home, the auction already ended.
me: so you sure you are not gonna get that car fixed?
vik: probably not man, sorry.
there was more, but just BS back and forth... me asking and coming with reasonable proposals to make the deal work, and him coming up with garbage to not sell me the car.
cliffnotes: i called and verified he is a lying sack of (insert explicit noun)

towards the end of my conversation on aug 1 with this clown, i told him to let me know if he changes his mind, or if the car is available. obviously, i am not expecting him to call me with a change of heart. saying that was more of a courtesy to end the call in a civil manner.
so since that deal is shot to hell, i decided to wait out the ordeal with insurance... to see how they handle this. i got a quote from a local shop (which a secretary at work recommended) and they said it's gonna be $3217.04. the guy giving me the quote said his computer gave him a "total loss warning", meaning if the insurance ppl have the same number, the car might very well be totalled. that would suck, becuz with the money that insurance would give me, i doubt i could find a car to replace my baby. well, maybe i could, but it does not look like an easy task. so i wait and see....
i still can't resist the urge to check out some cars online tho. i pop into ebay quite often to see whats up for grabs. while i was there, it struck me.... i wonder if jerkoff is buying/selling stuff? i look him up and see that he's been bidding on cars. all his bids were placed before his "main car blew up". today tho, he placed a decent $2500 bid on a saab. so he has 2500 bux, which leads me to believe that he is not as poor as he claimed to be over the phone... needing two weeks for collect $1000 to fix the car. of course, this story did change by the time the conversation ended. i hope he does end up buying something on ebay. then i can call him up and ask him to honor our deal. again, i do not expect him to say "oh yeah, meet me at so and so and we'll be down". i'm expecting him to give me more BS... perhaps even an admission that he sold it already.
then.... maybe then i will think lawsuit. as for now, i'm just stalking him online. it's a good way for me to kill time at work anyway.

Small Claims Court is a state court that tries civil cases and not criminal cases. Cases usually involve collecting money. You can sue for Property Damage, Contract Disputes, Personal Injury, Warranty problems, Defective products and Violation of Consumer Protection Laws. You can't sue in criminal cases and you can't sue for a divorce in Small Claims Court."
