what legally makes a check not a legal instrument?

I remember reading somewhere about someone who actually cashed one of these checks because it had all the necessary elements to be a legal check. I'm sick of all these pre-approval fake check things... what's the difference between fake and real? Or, what mistake does a company have to make such that I can screw them over... I'm sick of junkmail.

Alas, the check in front of me does not meet all the criteria. 🙁
Oh well, there'll be a dozen more in the coming week or so.
 
I get real pre-approval checks in the mail all the time. Unfortunately, they all have a contract on the back that says if I cash it, I'm agreeing to the terms of their loan which is at a very high interest rate.
