What happens when you post bail?

I've always heard about it, but (luckily) never done it. Say your relative commits a crime and the bail is $50,000.00. The way I understand it, you can pay a percentage (10%?) and your relative can get out of jail. Do you ever get that money back? What happens if your relative runs away? And why set bail so high if you only have to pay a percentage of it?

you have to pay it all (as far as i know), and you never get the money back. If he runs away, a warrant will be issued for his arrest.

You get it back if they stick around like they're supposed to.

And usually it is just a percentage (and a small one) though I imagine they make you pay the full amount if he does skip.

People who pay a percentage are paying someone (a bail bondsman) to post bail for them. The 10% is their fee, and you don't get it back.

Let's say someone is held on $50,000 bail. They don't have that much in cash so can't post bail. A bail bondsman will charge them $5,000, and will post the $50,000 bail to the court. The bail bondsman will want collateral to insure that he gets his $50,000 back if the person doesn't show up for court.

If you post your own bond, and appear as required, you get it all back (minus some small fee).

can you bail yourself out? it seems expected that someone else does it for you. and if you're say away from home on vacation or business, you're screwed.

But with a bail bond, you can...


You still generally need some money though. 10% is pretty much universal from what I know. So lets say its set at $50,000, you still need $5,000 in cash to get a bail bondsman to post it for you. And if you go through a bondsman you never see that 10% back.

You don't pay the court/jail a percent you pay a bondsman a percent and they post the whole bail. The court/jail has to have the whole amount to let you walk. You get it back when you present yourself in court. If you use a bondsman you are paying to use his money and don't get anything back, but you didn't have to pay a whole lot either usually.

The bail is to make sure you don't flee until your court date....certain things you can't post bail for and have to sit in jail for 'observation' about 8-12 hours.

Now if the bailed out party flees they forfeit the bail, but are not 'innocent', a warrant for their arrest will be issued, the bondsman will now hire a bounty hunter for the capture so he can now get the money back he put up, plus collect the reward that is usually offered. Usually also you have to put up collateral to cover the difference in the bail vs what the bondsman put up and even more common is for the whole amount of the bail. This can be cars, jewelry, and almost always involves someone's home. The thing is the bondsman doesn't want the BS to deal with and many times when a house is used for collateral, he doesn't automatically get it...he is stuck in line as a junior lein and has to wait for it to sell eventually (if ever)...now he gets more ticked and you become hunted.

Collecting on running felons is a big business. Sometimes you are worth more dead to the bondsman than alive also (you become an example so to speak).

Varies from state to state. Bail bondsman fees are universal because they're usually controlled by statute (to prevent them from getting greedy).

If bail is a small amount of cash, you get the whole amount back when the case is over - less a poundage fee in NY (believe it's still 3%).

I don't know of anywhere where they give back the bail or release the bond hold "when you present yourself in court." Sometimes, if the defendant's been showing up for each and every appearance and it's been a while, they'll release the bail/bond.

Haven't got the option to post bail, my stuff has had me sit it out.

When you go to jail for the night you are usually in a clear door holding cell, every 2-3 hours you have to get out and get roll call and then you get put back in. It's usually a guy cell and a girl cell side by side. The guys all looked p!ssed and the girls are all a mess of running mascara :).

During the night you are searched, your belt and any loose items (jewelry, wallet, etc) taken and inventoried, finger printed, get the mug shot and just wait for morning.
