What does it take for a mistrial?

A month ago I was busted with a pipe. They did 3 things I can think of that was wrong. First he didn?t read me my rights. Second, he put his hands in my pockets (I heard he?s not allowed to do that). Last he cuff me behind my back and I heard if you?re under 17 he?s not allowed to do this. When I go to court and tell them all of this do I have any chance of them canceling all my fines or anything like that?

Yes. When they find out that you were cuffed behind your back they will let you off scot free and give you lollipops so you'll forget that you were mistreated.

1. Bullsh!t. You don't need to be read your rights unless you're interrogated.

2. Bullsh!t. This is called a "search incident to arrest" and is 100% legal.

3. Bullsh!t. That's just stupid.

You're assuming he was being arrested for something else and that the pipe was coincidental.

Or the pipe was found before the search, or there was consent to search, or a Terry Frisk resulted in recognition of the pipe...

ok kid, you fvcked up, you're going to court. there's nothing a 17-year old can say that would result in a mistrial. and second, you're going to court! suck it up and gorw a pair and stop trying to get off.
