I was "randomly" chosen a few years ago because we had hamburgers and chicken sandwiches in regular brown paper bags at 9:30 at night. I was pissed, but what can you do. It's either comply or be killed.

Here are the statistics for 2011 by the NYPD. 91% of those stopped were minorities.

In 2011, 684,330 New Yorkers were stopped by the police.
603,268 were totally innocent (88 percent)
402,308 were black (59 percent)
176,165 were Latino (26 percent)
62,033 were white (9 percent)

So ATOT, a cop stops you at random and starts frisking you, what do you do?

So, which is it? Because you had plain paper bags which could be used for concealment or because you were black?

Heh, wake up. We DO live in a police state. Any civil rights you may have left need only be "observed" and exercised once you are in custody. Remember, you can be taken into custody for any reason the LEO deems proper at the time. Yes, you may be released later and exonerated, but that matters little at the moment. If anyone doubts this, I can bore you with the story of my son's two-year battle on a false DUI charge that stemmed solely from the judgement of the arresting officers.

Oh whaa whaa. Anytime I take a drive around here I need to drive through a checkpoint and affirm I'm an American, tell them where I'm going, what I'm doing, what I do etc. etc. before i get to drive on. Border patrol checkpoints 100 miles into the US. I'm glad the rest of you get a good dose of racism too. Spread it around in America!

Again, they have to have specific and articulable facts which reasonably warrant the stop. The state CANNOT revoke that requirement.



Technically, neither of those are "specific and articulable facts." Though in the first case if the officer observed that your dog was not wearing the license tag that would be sufficient to allow a Terry stop (though it would not be enough to allow a frisk).

To be clear, I'm not saying that these requirements will always stop every officer from ever stopping anyone without reasonable suspicion. All I'm saying is that the absence of the factors is sufficient to support a civil rights suit on 4th Amendment grounds.

You would think so, I showed him the tags on the dogs neck, AND he said that didn't count - he needed the paper registration in my wallet. I just complied then - I wasn't as angry (or aware of police wrongdoings) as I am today.

Driving is completely different than walking.

You agree to a whole bunch of laws, rules and requirements when you drive. With that being said, there is a famous video of a guy getting out of those checkpoints with the "am I being detained, am I free to go" lines.

Doesn't matter. We were doing nothing but walking home (3 of us, not even a big group) and we were stopped.

And quotas even lead to planting of drugs onto suspects.

A police officer in Queens recently admitted that the use of enforcement quotas led officers to plant cocaine on innocent people in order to boost arrest numbers.

Doesn't matter. We were doing nothing but walking home (3 of us, not even a big group) and we were stopped.

I'm saying that you are accusing them of ONE but giving statistics about an unrelated type of prejudice, which is kinda silly. If you are saying that tehy really did it because you are black and that the paper bag thing was made up, then call them out on it and don't give the paper bag excuse any relevance.

in any case, happened to me TWICE.

1) 21 years ago in asstown detroit. got pulled over with three homies in the car. the cop said there were reports of folks making trouble in the hood. they put us against a wall, frisked us, and searched our car for a long time since dumbass friend carried bullets with him like a dumbass. no gun.

2) 11 years ago close to asstown Detroit on freeway. some fvcker cuts me off. i then cut him off. he called the cops and falsely reported that i had a gun. black car, tinted windows. thatwas me. its weird, the truckers on the road must have gotten a radio message and they kept trying to block me in or cut me off. 10 minutes later 6 or 7 squad cars pull me over. guns pointed at me. i wasnt scared but was like wtf. hands behind the head and kneeled on the side of the freeway. humiliating. they cuffed me, searched my car, and found nothing. i asked why they believed a fvxker that called that lie in. their response? he said he was a doctor and they believed him over me :\ they threatened to throw me un jail if i didnt just shut up and leave town. i just shrugged it off as i didnt know the law well.

fvckng copholes.

If they dont have one, then we can get their name/dob and run them on records to see a picture if it matches up. If they refuse to give name/dob then their night just got a lot worse. They're cuffed until we can prove who they are. And when cuffed, they get a "Terry pat", for their protection and mine.

We cant pull over any car with probable cause either. But there are many reasons to do so, such as, no tag light, broken tail light, head light out, leaving a car running unattended, no mud flaps (on certain vehicles), a bumper too high, not using a turn signal, broken windshield, etc. There are so many reasons you can pull a car over if you want. If you think something is going on, or that they are up to no good, you can almost always pull a car over. However, if there is nothing wrong, and there is no probable cause, we cant do anything. In my beat, most people dont have one (or more) of the three state required things to have to drive, a) valid license, b) insurance, and c) registration that is up to date. 90% of the people I pull over are black, but thats because 90% of the people who live in my beat are black. Its all projects and crappy housing. You get a feel for who has everything, and who doesnt. Sometimes you get surprised though.

So in both cases the police had a reasonable suspicion that criminal activity may have occurred or been occurring... and they are wrong for investigating it?
