I just erad an article that he is scheduled for another trial. I'm just wondering what you all think. He could have plea bargained and did eight years but I think he or his family declined that and went on through the trial. Eventually the kid got life without parole. He's only nine years old serving his term in a juvenile detention center.

Correct me on the age but I don't think he is older than ten.

***edit: the boy was 12 years old at the time this occured***

Look at that guy that recently got out of jail from serving twenty three years only to come out and find, stalk, rape and probably kill another woman. Compare that to this guy and that is nothing. I understand he took a life but I think it was a really really big accident and I'm sure that he did not mean to "end her life".

***UPDATE: Link***

He is going to plea bargain and he will get three years in prison (he has already served that) along with one year under house arrest and ten years probation.

So it looks as if this kid will be freed.

***UPDATE FOR 1/26/04***

He was freed today!

wasnt he 12?

its sad i think, but from wat i have seen inthe news, during his first trial, when they tried him as an adult they didnt take into account that he could be incapable of making the kinda decisions required to be tried as an adult

i hope he gets another fair trial

but either way its sad

Ahh yeah sorry, he is 13. I thought he was only 9 or something. Still though, I thoroughly understand that the parents of the girl would like to see him put away for life without parole and even probably the death penalty, but this guy is 13. Oh well though, he did go through the legal system and that is how it works.

This story is old news. But it was brought up again recently. I saw an article that said he's up for a re-trial.

I had to do a report on this. Are you talking about the one "large" kid who was wrestling with the younger girl his mother was babysitting. I don't think deserves life because he was so young. But there were multiple bruises, and a punctured and torn liver, and broken ribs, not sure on the ribs. Plus he kept on changing his story every other time he testified but then agian he was 12 when he did it I think.

I feel sorry for the kid and my first inclination is that he's been wronged. At first I told myself that the kid (Lionel Tate, if my memory serves me correctly) was too young and that it was an accident. However, we shouldn't forget that even at a young age we realize that hurting other people is bad, plain and simple. At 10 years old I knew what death was, but more importantly, I think every 10-year-old knows what it means to hurt someone else.

I don't think he was trying to kill the girl. In fact, I think anyone that thinks that is a moron. I do think that he was trying to hurt the girl in some manner or another (not seriously either) and should be punished accordingly. Life in prison is ridiculous. Even an extended period of time in a detention center would be uncalled for IMO. Tate deserves another trial, plain and simple.

I think this was said with a bit of sarcasm, but in case you're genuinely curious, it was in Florida.

I agree that he deserves another trial. Like I said, he was offered a deal if he plead guilty to manslaughter he would only get eight years as opposed to getting life without parole. He or his family declined that offer and went ahead with the trial and ended up getting life without parole.

Is that what you think?
In reality, no.
I'm just playing off the acid in the eye thread.

Anyway, the family declied the deal. All they can do is appeal, just like the rest of the convicted criminals.

I'd say his parents need to be tried. They obviously failed in teaching him any sense.

From the abcnews article:
Lionel...was a very large boy for his age, nearly 6 feet tall and 166 pounds. He never seemed argumentative or violent to her, she said, and he had played well with Tiffany, who, at only 48 pounds was about a third his size.

The autopsy showed that Tiffany had suffered a crushed skull, broken ribs, more than 30 internal bruises. Her liver had been shredded and pushed through her rib cage.

Unless this kid was literally a moron, he knew he was beating the crap out of her. Any single one of those injuries would make me scream like violated cellmate. There's no way he did all that in one shot. Let him rot in jail.

How the hell did his mom sleep through the screams? Something's very fishy here.

That's messed up. There's more to the story. And that could could probably have beaten the heck out of me when he was 10

Something's wrong with the parents when their child disregards screams of pain, the most basic of warnings to stop.
