Depends on where I'm at. If I'm at work, I'll be driving one of my work cars, and I won't care. I'd take their picture and call the police. If I'm at home I would probably hold them at gunpoint while I call the cops.

How much bigger than the perp were you, and how did you physically detain them?

This was my senior year in high school. We probably were about the same size, but he was a couch potato and I was a wrestler. When I caught him doing it I blind-sided him and shoved him in to my car, told him I called the cops. He tried to wiggle away so I put him on the ground with my knee in his back and some others came to help.

I doubt I would do the same these days.

Id just kick his ass and await whatever legal reprecussions might ensue. Screw letting him get away with it. I want some justice even if its vigilante :)

Personally I would call the cops, let them take the report, and follow up with them to see what the final disposition was. Then I would request a copy of their report and file a small claims case. If you actually saw the person then it is up to the small claims court to figure out who is telling the truth and you don't have to prove it beyond a reasonable doubt since it is a civil action. The fact that you called the police and reported it along with providing them the name of the person will all help you.

What? I'm under the impression the US is still the furthest away from not letting you defend your property (depending on the state and other westernized countries). I'm thinking specifically of England as to defending criminals but from what I read in the news, other European countries are the same.

I'd take the risk on the arrest.

He'd be screwed either way. May just end up burying the body in the school behind my house once I remove the teeth and finger tips.

Why couldn't I detain him? I've ran down and held down a thief before and I'd do it again.

If someone was keying my car I'd probably laugh at him or at least encourage him to do a good design. I've keyed my own car before just to see how easy it is and didn't feel like damaging other people's crap.

Why couldn't you make a citizen's arrest? Bonus points if you take pics or video of the act as evidence.

Here's the Colorado statute:
A person who is not a peace officer may arrest another person when any crime has been or is being committed by the arrested person in the presence of the person making the arrest.

same thing happpen to my rental car, i walked outside to smoke a cig and saw 2 jits spraypaintig my car(my tires were slashed also) i called my roommate and we took them on took their money (to repair the car) and then took their phones to call their parents. Their parents wanted to press charges for us whooping their ass and i told them to go ahead, we argued for a bit but the dad was respectful and offered to repair the car out of his own wallet, we gave the money back and took the dad the next day to the body shop to repair the spray paint and replace all 4 tires. We knew they stabbed the tired cause one of the kids had a cheap blade on him.

But that only applies to my bike...I don't care about my car the way I care about my bike. If it was my car I'd just plain shoot them.

One of the reasons I like Texas. Stance of Dominance is always accepted.

In california, you would have to help him finish vandalizing your car. the law protects criminals in this case, if you even touch him, it is assault and battery, possible kidnapping and imprisonment.... you're in jail and he goes free. You cannot defend your property with force, you have to call the cops and wait. that is justice.
