What can my friend do?

My friend was offered a job recently. So he turned in his 2 weeks notice. A week later the company that hired him called and told him that they no longer have funds to have that position. So they can't hire him. Now my friend cannot go back to his old job because his boss will know that he's looking for a job so that if there is a promotion or anything he will not get it.. because why give a promotion to someone that is not "loyal" to the company.

Can my friend file small claim to the company that was going to hire him for loss wages for the time that he will be looking for another job? What can he do?

Just from personal knowledge, I don't think anything is binding unless he signed a contract.
Unless of course the state he works in/hiring company's location is in a state where verbal contracts are recognized.

Hope that helps.
If neither of those have occurred, I doubt he'll be able to sue for "lost wages" never earned.

He should go back to the old job until he can find something new. Who cares if he won't get a promotion.

if he's a good worker maybe they'll offer him a promotion to stay if he asks nicely :p... never know hehehe

He can try to go back, but if I were his boss I wouldn't want him back. He's already left once, so he's just looking to do it again. I'd rather hire someone who'll stay a while and not jump ship at the first chance of another job.

so basically he's screwed eh? dang.. sucks for him.. he just recently got into an accident..and purchased a house too :(... now with the possibility of being unemployed.

exactly! that's why he can't go back to his old work.. why would an employer keep a employee that is looking for another job..
