bought a van from sons friend. he bought it at junk yard and fixed it . took title to currency and they said its not signed by owner or the auto dealer on it. called the dealer they said the junk yard was not supposed to sell it and should not have given the title. the guy still owes over 2000$ on it. what can i do ? if i can get the dealer to make a deal and stamp the title can i keep the van and be able to title it legally in my name? thank you

Seems like you're pretty screwed, you should not have bought a vehicle that didn't have the title in the seller's name. Seems like the title had not only the previous owners name but a dealer as a lienholder on it, which should have been massive red flags for you.

If your son's friend never actually filed for the title to transfer to his name, he was never actually the owner.

Just because you bought "stolen goods" doesn't entitle you to them.

In my state, the original owner has to have the title released by the lienholder and reissued to them before it can be transferred to another party - I don't know the details about if or how the lienholder can transfers however.

It sounds like a bad situation all around.

Almost nothing. You can try to swing a deal with the dealer, and file a small claims court action against the junkyard. The dealer will likely not budge much if at all. The junkyard *may* pay a bit to deal with the headache.

The dealer has winning cards, the junkyard has good ones so play your best hand or fold.

And on-topic ... I would go after the junkyard since they're the ones actually responsible for "sale of stolen goods". (which can be charged as a felony in many states)

My BEST offer would be full refund and I'll consider not pressing charges and/or sueing.
