The cemetary has the right to keep trespassers off their property. Does the family have a right to stop people from protesting on public property? No.

Apparently, they're funded by the Phelps family and the winnings from the lawsuits they file against people who would prevent them from staging or otherwise interfere with their protests, as well as private donations.

In other words: The WBC do this on purpose, with the full intention of pissing people off enough to react. Then the WBC and Phelps family sue, and continue their operations with the settlements.

It's easy to milk folk who hate themselves. Self hate is always masked by self importance, self hate's denial. All you have to do, then, is insult somebody and they will be guaranteed to fly off the handle because you poked them right in their big fat ego, made them feel how worthless they are denying they feel, and voilà, a lawsuit from the reaction. There is no fool like the fool who hates himself. And that would be you and me.

Once you realize what an idiot you are, you can begin to think and take action.

If it were not for self hate, nobody would even notice this family exists. To put somebody down who really loves himself is just to make sounds in the air. Only us morons take seriously the notion that our children deserve to die because America allows gays in the military. How can such hate and passion be generated by such a moronic idea. Ego, the ugly opposite coin of self hate, is the only reason.

Only self hating fools believe God kills people. Only a fool feels any need to get back at those who utter such imbecilic words. But fools can be easily played, and there can be money in it too.

Overall this was a good ruling, the court really sidestepped some of the larger issues regarding state laws and such, and ruled specifically on this case. As despicable as those Phelps scumbags are, freedom of speech demands that people can not successfully sue them for damages based on their peaceful speech on public property.

The tort of intentional infliction of emotional distress really has nothing to do with hate speech, they are two completely different things. And hate speech prohibitions are hardly about any right not to be offended. Generally put hate speech provisions are something like a sentence enhancer where a regular crime carries an increased penalty because of the prepetrator's expressed motivations.

Falwell tried that vs Hustler and lost 9-0. Looking at the shorthand elements of IIED (http://en.wikipedia.org/wiki/Intentional_infliction_of_emotional_distress) I can't imagine just shouting mean things to perfect strangers at a funeral would qualify, at least not to the tune of any significant amount of damages. Another hurdle would probably be documenting the harm caused by these acts over and above the harm caused by the death of the family member. Tough case to prove if you were physically and mentally sound when your son died but someone callling him a i love you at the funeral is what caused you to have nightmares and depression. Then you have the political nature of the speech/insults here, likely differentiating this case from your standard IIED where there is usually (I assume) some sort of personal history between the parties.

Someone may try to give it a go when defending against an IIED suit but free speech isn't a defense to defamation and I think most courts would analogize the same for these types of cases.

We do have laws against certain speech such as sexual harassment, fraud, liable, slander etc Judges are pretty smart and could have came up with something here IMO. Might save these people life.

Huh? "Sexual harassment" is not a crime, it can just get you fired/sued in the work place.

Nothing else you listed even comes close to being relevant.

It isnt a judge's job to "come up with something." They are to follow the constitution.
