Were my friend's rights infringed by the cops?

My friend said that last Friday night he was on a simple 2 way, 2 lane highway when traffic stopped completely. The reason: "DUI" check point by police. WTF? Do they have any right to stop every car? Does he not have the right to say that he did nothing illegal, thus their stopping him is against his civil liberties, and that he wants to be going on his way? It sounds like the militarization of our state and local police is here. What is this, Moscow? Is it legal what the cops were doing???
 
Here in PA. they do, and do it often, almost every other weekend.

Also, with the 4th weekend here, there'll be seatbelt checks on a few of our most traveled roads.
 
Hello...this has been happening for YEARS, so it's not new. I've no problem with it because it nails a lot of drunks.
 
I think it is hilarious how everyone thinks their rights are being trampled any time a cop sneezes funny. People don't complain this much when their freedom of speech gets infringed.

It can't be random. it has to be every 3rd car, or every truck, or something like that. A cop told me that, but I've no idea the valididty.

as long as they dont search my car i could care less. (not that i have stuff in my car, but that would be raping the 4th)

Plus I'd rather inconvenience myself than let a drunk asshole drive around

It's been a long time since the Supreme Court last upheld that position (1990 according to the article).

Also, think about the time of year that it is. Alot of police agencies are out trying to catch drunk drivers this time of year. Would you rather that they just let all the drunks alone?

michigan is not too bad in terms of civil rights. No check points and no "right to stop and investigate" clauses either. I LOVE this country.

Goodbye America? Like I said it's been happening for years. The only time I've been stopped was in Canada, so they do it there too.

They use them also to check for registration and car safety stickers. You are, afterall, on a public road using a motor vehicle that can cause a lot of damage.

Instead of being pissed at the police you and your friend should be grateful that
they do have random checkpoints for DUI from time to time. The drunk driver
they may find with these checkpoints (and they do catch plenty) might have possibly
crashed into a family member or someone you know.

Is a few minutes of inconvience worth that?
 
You must be really young if you've never heard of a sobriety check point. If it keeps a couple of dumba$ses off of the road then they can have them every day for all I care.
 
Would you rather it was random cars? So that when your buddy got "randomly" selected you could bitch even more that he was singled out because his car is riced out or because of his skin color or for some other innocuous, stupid reason that you could come up with? Checking every car makes it more legally justifiable and sidesteps any issues of the selection process and police "profiling" in the searches.

Perhaps you should move to Europe then, where the police can search anyones car at any time without a reason at all. Just on a hunch.

Grateful? Kiss it buddy. You are buying into it. This is crazy. This is not America. It is guilty until you prove your innocence and that is NOT RIGHT! Put out more patrols and take care of the weaving cars or irradically driven vehicles.

Oh man... well the way the cops around my college used to do it... They would have a check point ask you to lower your window because they wish to "tell you about a drunk driving brochure"... when telling you of said brochure... they get real close to the window and try to smell your breathe... if they smell alcohol they ask you to pull over... needless to say i got pulled over once when I had only had like 3 beers in a 3 hour time... I passed all his tests and then passed the breathalyzer... and went on my way...

Unless it takes really long and you are in a hurry, I don't see why its a big deal... takes drunks off the road =)

Naw, I'm 24. I just never had anyone I know run into one. It was 30 minute wait!!
 
yeah. every new year's eve and fourth of july, a bunch of cities around me do it. traffic sucks, but I don't mind.

when it comes down to it, driving is a privilage, not a right 🙂
