Actually my wife went this morning as she is the person listed on the petition for eviction and judgement. Basically, we were prepared to present evidence that the dates listed in the petition for unpaid rent are actually paid (we have receipts), and more than likely the dates listed were to be from a year earlier, so we would have had that hearing thrown out on a filing technicality anyway. And before you ask - yes, our current rent is paid and yes, we are paying our past due - so don't even go there.
Anyway, my wife tells me she walks in and the property manager comes in as well. The petition was filed and signed by the property manager - to which the judge had great dismay. According to my wife, the judge asked the prop. manager whether she was the landlord - and she said no. The judge then asked who the landlord was, to which she responded his name. The judge then said that she has no authority to sign or file the petition, and that the landlord himself must do so, and appear in court. The prop. manager then said the property was owned by a partnership, to which the judge asked who the partnership was. The property manager responded with an "I don't know other than my boss".
Case dismissed.
The landlord himself should be thoroughly pissed by now, as he is a CPA and it means either he will be waiting until after tax season to take us back to court or he's going to have to take his "valuable" time to do so. Heh.
Oh, did I mention that one day I had a meeting with him, got there, and had to wait about 45 minutes to see him because he was taking a NAP?
