Weird issue with overclocking e6300 on DS3

So I am getting a rather strange error. If I overclock even a tiny bit, my new build won't run direct x 9 games. I get this error "Direct3DDevice9:😛resent failed: driver internal error"
Any idea what is going on here? I've tried F3, F4, and F4e bios, dosent seem to make a difference. Seems stable in every other way.
