Alright, some of you may not remember my first thread on this topic, so here it is:
Wedding Photo Nightmare: Part 1
I recently followed up with the photographer to find out why we had not received the reprinted photos we had requested. He stated to me at that point that he had filed for bankruptcy and that I could have the original, high quality digital photos. Naturally, I was quite upset as I feel that he filed bankruptcy on his small little side business as an easy way to get rid of his problem. I filed a complaint with the better business bureau and received his reply yesterday. He stated that he guessed I did not understand what bankruptcy was and that I should contact his attorney. I called the attorney's phone number and left a message yesterday evening. I then called the photographer who would barely even talk with me on the matter. Keep in mind, I'm doing the right thing here in being very, very patient and very, very civil to him. I asked again, if he was going to send the digital photos on the disc(s) and he told me he would if I would send him a letter requesting them and stating that I would not pursue the matter further. To me, this is not only an admission of guilt to some degree, but also a form of blackmail. He has photos that I paid in full for well before he filed for bankruptcy and he now wants me to make a statement that I am not going to pursue the matter further? Needless to say, I am seeking legal counsel on the matter as I feel I am not limited here in what I can collect from him. As far as I can tell so far, he has committed breach of contract and misrepresentation of products/services at the very least. Just because he filed for bankruptcy should not in any way limit me in pursuing him for photos of the one day in my life that can never be recreated, right?
Anyone who can give me good, sound advice on how to pursue this, I need your help. "Help me Obi-wan Kenobi, you're my only hope."
