Alright, some of you may not remember my first thread on this topic, so here it is:

Wedding Photo Nightmare: Part 1

I recently followed up with the photographer to find out why we had not received the reprinted photos we had requested. He stated to me at that point that he had filed for bankruptcy and that I could have the original, high quality digital photos. Naturally, I was quite upset as I feel that he filed bankruptcy on his small little side business as an easy way to get rid of his problem. I filed a complaint with the better business bureau and received his reply yesterday. He stated that he guessed I did not understand what bankruptcy was and that I should contact his attorney. I called the attorney's phone number and left a message yesterday evening. I then called the photographer who would barely even talk with me on the matter. Keep in mind, I'm doing the right thing here in being very, very patient and very, very civil to him. I asked again, if he was going to send the digital photos on the disc(s) and he told me he would if I would send him a letter requesting them and stating that I would not pursue the matter further. To me, this is not only an admission of guilt to some degree, but also a form of blackmail. He has photos that I paid in full for well before he filed for bankruptcy and he now wants me to make a statement that I am not going to pursue the matter further? Needless to say, I am seeking legal counsel on the matter as I feel I am not limited here in what I can collect from him. As far as I can tell so far, he has committed breach of contract and misrepresentation of products/services at the very least. Just because he filed for bankruptcy should not in any way limit me in pursuing him for photos of the one day in my life that can never be recreated, right?

Anyone who can give me good, sound advice on how to pursue this, I need your help. "Help me Obi-wan Kenobi, you're my only hope."

PS - I have to keep the humor in this or I am going to explode!!!

Call your local news station. Reporters here in Boston seem to love stories like these. The consumer fraud reporter will dog this guy until he cries mercy.

That seriously sucks. I feel for you. This guy is a slim ball trying to cover his ass. Get an attorney. No judge or jury is going to feel for this guy. I think that since your contract and sale came before bankrupcy that you will be the first person to get repaid. I am no lawyer though. What I worry is that if you do go after this guy all he has to do is erase the pictures WHICH really would suck. If he did do something so horrible I would make this guys life hell. You have been more than patient.

A family friend of mine had a wedding in Hawaii. I thought they were going through hell. It took 10 months to get their pictures but they were absolutely beautiful. They ended up spending $4000 on pictures!!!!! But after seeing the pictures I don't think I would have been able to reduce how many they bought.

Dood, you are probably SOL. That's what happens when companies file bankruptcy. If they guy has nothing, the TV station can't do much to help you. They might be able to squeeze him, but I"m sure he'll tell them to take a flying leap and talk to his attorney.....That's what deadbeats do when they can't pay their bills. They run and hide like beatches....

What type of bankruptcy did he file? That might make a difference, of course.



Keep fighting though.....

TV station won't do anything, sounds like he's just a guy who takes some photos as a second job. I would definitely want to get a lawyer, if I were you, and not take advice off an internet message board. A lawyer will tell you for certain whether or not you have any legal recourse with him. If it were me, I'd do it regardless of the cost of the lawyer, because i'd be so pissed off. Good luck.

I could see if he was asking for money, the bankruptcy court would tell him to wait in line behind the other creditors (if there are any.) However, with this situation, this individual just wants the digital photos back - as they reside on the disc - that's all. I hardly think that this is too much to ask for. Apparently, the photographer must be in deep sh!t in order to ask for a statement that no further action or claims would be made against the photographer.

I like the news bit. Sure, since there's a bankruptcy involved, there's little that can be done for the current situation. However, what's going to stop this photographer from starting another photography business in a year or so? If the news were to broadcast this individual's name in a report, the photographer may not have so many clients when he starts his next business.

Good human interest angle, which is what those "Fighting On Your Side" kinda shows are all about.
I can hear the lead-in now...

They thought it would be the greatest day of their lives.
And the photographer they hired was supposed to capture it for them to enjoy...for the rest of their lives.

Now, trying to get their pictures from that photographer has turned into...A NIGHTMARE!"

I can make this even uglier for him if I so choose to do so. You see, back in September I was mobilized as an Army Reservist. We had planned to get married this past May and we were determined not to let the Army or the current world climate stop us. We got married at Fort Riley, Kansas, outdoors, in defiance of terrorism. It's truly sad that such a low-life would take advantage of an Army Reservist Military Police Officer who's defending his freedom to be such a scumbag. I am a soldier who's been taken advantage of and that will anger the general populace. I have considered taking this story to Bill O'Reilly on occasion and I think it would be good to do so.

See? I can really make things ugly for him, but as of yet, I've been very, very kind.
