Actually, based on that article, allowing that lawsuit to go through sounds perfectly reasonable. You didn't mention that the old lady died from her injuries. Civil court is the appropriate place to determine if one party (the child's parents) owes damages to another (the deceased's estate).

The case in the OP is criminal law, and is a pretty shameful display of corruption.

The article states that she died three months later. At 87, that's hardly proof she died of her injuries.

The IRS released data showing that the top 400 or so richest americans paid an effective tax rate of about 16% because the capital gains rate, which the rich benefit the most, was cut to 15% by Bush.

I'm collecting unemployment right now because it's there. I don't need it, but I'm eligible so I damn well am going to take it. I'm against unemployment as it currently exists, and if I could scale it way back, require working part time for the state to collect in order to incentivize getting a real job, or put some other limiting feature on it I would. But until the system changes, thanks for the free money. I enjoyed my almost 7 month paid vacation at the expense of the working stiff. Hell, I've been making the equivalent of a $15/hr full time job sitting on my ass and trolling this forum, which is more than a lot of people make busting their ass day in and day out. And I don't feel the least bit guilty because this is exactly the way all the bleeding hearts want it to work.

It's up to the lawyers to prove their case at trial upon valid medical testimony and evidence admissible under the rules of evidence. The issue decided was whether or not they were going to be allowed to present their case for trial at all, proof comes down the road.

Boberfett's claim that the NY case is political in any way is just unfounded silliness, as near as I can tell.

Not really. You are apparently too retarded to know that there IS an incentive to be looking for a job while on unemployment. The longer you're not working, the harder it is to get employed. In fact, many companies are posting job offers that are requesting applicants who are employed at the moment and they're not even looking at unemployed candidates.

Keep sitting on your ass and eating cheetos, you're in for a big surprise when unemployement ends and congress is NOT going to extend it.

Actually, she was not killed by the accident, but broke her hip, which is enough to sue over. Of course, the lawsuit would really be against the parent, who is responsible.
