Was this an acceptable shoplifting?

Four or five years ago, I bought my mobile phone phone from Circuit City. I was a long time ago, so I can't exactly remember how much I paid for it, but I think it was around $200 to get everything started. It was also the first and last time that someone talked me into getting the extended service plan. I didn't realize it at the time, but they totally lied to me about what was covered. The salesman said something to the fact that "everything" was covered. I do remember asking him if it was covered if I droped it, and he said it was. The service plan was around half the price that I paid for the phone. In other words, I paid close to $100 for it.

Around a year later, I droped the phone and broke the antenna. No problem... I have the high dollar extended service plan. I walk into Circuit City with all my paperwork and the broken phone. The manager dude behind the counter looks at it 3 seconds and then told me that the service plan doesn't cover physical damage like this. I was a little pissed seeing as how I was told that EVERYTHING was covered. After some bitching, I realized that I wasn't going to get anywhere with him. The friend I was there with was looking at the mobile phones, so I walked over there to get him so we could leave.

That's when I noticed the display Nokia 2160 phone sitting there with a perfect antenna. I unscrewed the broken antenna from the phone in my pocket. Then I unscrewed the good antenna from the display phone. The I screwed my broken antenna into the display phone. The I made my way to the door. Since this was the first and only time I have ever stolen anything, I was nervous about it for a few days. I kept expecting to get a call from Circuit City asking for their antenna back. They had just looked up all my information on the computer, so they knew who I was.

I don't feel all that guilty about it now. The way I see it, I paid $100 for that antenna.

No it wasn't acceptable. next time be sure you understand the contract that you are signing.

well, shoplifting is never acceptable.. but i won't judge against you. i probably would have done the same thing.

1) Your salesman was an idiot
2) Those display phones aren't real. (unless that's a new thing)
3) Stealing is never right. Perhaps you should have been compensated, but you are still not justified in stealing.

I know I should have read the service contract, but I didn't think I was being lied to about what it covered. It was so expensive, that I would expect it to cover everything.

After reading the contract, I realized that it didn't cover anything that was likely to happen to the mobile phone, so it was a total waste of money.

update... I had the phone for about a year and a half.

which is why those contracts are all margin

damn man, i think you did the RIGHT thing... no one is ever gonna buy the display phone, and you got what you paid for...

sounds to me like they tried to doublespeak you into the service contract...

thats another reason why i never buy any extended service plans from retail stores. Your paying $300 for 3 years supply of bullsh!t.

lol that's not doublespeak, that's just plain lying.

I'm a commissioned sales person at CC. I fully back service plans, but I am honest about them. If a customer asks me about it on a cell phone, I say don't get it, unless they are buying a $400 color screen phone that they say they will never ever drop. Even then I don't push it hard.

The contract you bought came with paperwork. Can you read?

It also allows cancelation within about 3 days.

I understand you being upset and really doubt they will miss the antenna you 'replaced.'

I'd never try it again if I were you, but please learn from this.

You were not arrested. They let you replaces the antenna with the broken one and did not stop you.

Learn from it and go on your way. You did wrong, but I find it hard to condemn you given the circumstances.

circuit city service plans? I just returned one yesterday that I bought 32 days ago. 32 > 3 :)

oh i hated working at CompUSA because of the warranties. They would tell you to tell the customer anything to get them to buy the warranties. I'm like I ain't lying to noone about this. And it's amazing that i was the store leader in selling extended warranties cause I was honest.
The funny thing too, is they didn't want you to say the word "warranty" it was an extended service plan or protection plan" I just didn't dick around. People would come in buy a $2000 computer I'd be like ya know, for X dollars we can cover what the manufacturer does for an additional X years wit hour own warranty. Everytime I said that and a manager hear, I'd get written up, but then they'd look at my numbers and be like nevermind.

Well I don't find it "right".. but I probably would have done the same.

I dont' see it as a big deal though. Those display phones get beat up quite badly over time, and just get stored away till the end of time once they stop selling them. No biggie.

When I bought my phone it was the display model. Last Motorola they had, they were phasing them out for Audiovox or something. Got a nicer phone for less money (only $25 since it was a new contract and the phone was the display phone). Phone's still going strong almost three years later. Crystal clear and it's never dropped a call.

I don't think there is anything such as acceptable shoplifting. However, you were lied to several years ago when you bought the service plan. If I were you, I would have kept pushing up the management chain of command - until you received the response that you were looking for. Eventually, one of the managers in the chain of command would have given you what you needed/wanted - and you wouldn't have had to feel guilty about your actions. Actually, if I were you, I would have demanded that they returned the amount of money that you paid for the service plan - and provided you with a new antenna. I really hate salespeople who lie - just to make a sale.

A situation came up a few weeks back when I purchased a new cordless phone at Best Buy. The dweeb at register tried to pimp an extended warranty on me. I asked if it covered replacement batteries. His response was "yes, it does." Yeah right - I told him he could keep the extended warranty.

wow you didn't get nearly as much support in this thread as I thought you were going to. I am generally very honest but when it comes to this particular situation, I don't see it as being wrong at all. It's like the employees taking the last hamburgers at a fast food restaurant at closing time that are just going to be thrown away anyway. You took something that would never have been sold or used at all, and never would have made Circuit City richer by a single penny. You did no harm whatsoever to CC because they won't ever have to pay to replace that antenna -- the phone will probably be thrown away soon anyway.

On a side note, I'm surprised that a display model had a working/removable antenna at all. All the display models I've seen have been cheap hollow plastic dummies with stickers over the 'display'.
