There are a lot of smart people in ATOT. A lot of you spend a lot of time researching on the net anyways. You guys want to be my defense in my court case coming up on December 26, 2001? I could tell you all the facts, and we could plan my case with research on the subject. I dont know, I could use all the help I can get and I cant afford an attorney. I make to much for a court appointed attorney. I am home recovering from surgery and have some time, but I know that there is power in numbers. Its not a big case, its a traffic ticket for turning left at an illegal time. I will tell the story quick, if anyone is interested we can plan my defense via email and I will post the results on the 26th.
I went to work at 6am, did a few of my tasks (ie. print reports, change tapes, check times, etc). I forgot that I HAD to go to the bank to make a deposit. I took off from work about 0645 and drove 4 blocks and took a left from Maryland Ave. to Rice Street. There is a sign saying no left turns from 0700 to 0900 Mon-Fri. I knew it was before 0700 so I turned. 3 blocks later I am getting pulled over, didnt know why. The cop ran my plates, waited for the results and walked to my car. Said "you know why I pulled you over?" I said "I have no idea". His reply "you made an illegal left turn back there. You cant make a left turn between 7 and 9. Did you know that?" I looked at my watch........0656......I said " yes I am very aware of that." He left with my license and insurance and returned 6 minutes later explaining what to do with the ticket. I looked at my watch when he walked away and it said 0702. I work at a Neighborhood Assistance Officer with the St. Paul Police Department, actually I am a volunteer. I patrol this same (central) district. I obey laws, I have no record, I have no tickets.
I have delayed court twice (per advice) and was told Nov. 6th by Kim at the City Attorneys office that the case was continued for dismissal. She told me that "they dropped it, dont worry about coming to court." I took her name ..............in case. Two weeks later I get a subpeona in the mail to appear on Dec 26th. I called the CA Office and Kim said "well, I can just tell you what I saw on my screen. You need to talk to someone else." She transfered me to ( I cant remember her name but have record of it) and she told me "Mr. Sysadmin, Kim did not tell you that court was discontinued. She cant do that. You need to turn yourself in, we have a warrant for your arrest!" I was in shock! A warrant for what? I havent even been to court yet? She said "Im not going to play games with you. You failed to show up for court and failed to show up for an alcohol/drug accessment. There is an active warrant out right now. Come turn yourself in or we will come get you." I told her that she must have the wrong person (which they did, different middle name and DOB), she told me that she wasnt going to argue with me and hung up. Now I got a message from the Chief Prosecutor that he will see me in court on 12-26.
My defense is .......it wasnt 7am. I had just checked my watch to the atomic clock and the naval clock 10 minutes prior.
I cant afford to pay the ticket, I wasnt in the wrong and I dont need it on my record.
So..........wanna help?

If you didnt make a illegal turn between the 7-9 street, why worry at all? If your sure that thats the case, then whats the big deal since you didnt break the law?
How much is the ticket?

If you are making enough to not get a court appoint attorney, you can afford to get one for this kind of ticket. You can get one for under $1000 and will clear it up. Its easy to say that you missed your appearance (you should never take the word of anyone about NOT showing up, thats YOUR fault), but to say that you are wanted for someone else's crimes is another thing. Go there, with a lawyer, showing that you aren't the person that has a warrant for your arrest and it will get cleared up. Mistaken identity happens (happened to a friend of mine), the best way to get it cleared is for them to physically see you, your drivers license, etc. But I would DEFINITELY talk to a lawyer about the situation.

Kenji brought up a good point. The police cars do have a camera which displays the exact time. I dont see what the big deal is even if made the turn a few minutes after the deadline.

If you woulda jsut went to court in the first place, showed the judge the ticket, pointed to where it said "7:02" and said "my clock said 6:56, he pulled me over and wrote this tickets several minutes later". The judge would have jsut dismissed it. But now, by not showing up and all this other BS, you've made it a lot harder on yourself.

under $1000? most of those $40-60 lawyers could easily get you off for this kind of ticket. When they see you have a lawyer, they will most likely bargain you off with something like probation or defensive driving or something.

The fine is $100...........I have called three different law firms and they want $500 to defend me. I already got the warrant straightend out, saving myself $500 that a lawyer wanted me to pay him to do it.
I have missed a ton of work and am off for a month right now recovering from surgery. I DO NOT have $100 to pay for this ticket, unless I dont buy gifts for my 8 yr old daughter for christmas.
I missed court per the City Attorneys Office thats why they gave me another court date, not my fault, what do you do when they say dont go to court? Go? When?
My watch was not off, was the officers? Need to prove that.
I guess I dont have the extra cash like you big shooters to just pay a ticket for something that I didnt do. Or pay a lawyer big money to defend me. Or pay the higher insurance premiums for the next 5 years. I have applied for a pt job driving but if I get this ticket I can forget that job.
Thanks anyways, I will turn it over, go tell the truth and see what happens.

This is a traffic violation right? If so, don't most traffic courts cut your fine in half just for showing up? Hell, they even started a thing in my county where you just mail in something without having to show up and your guaranteed to get your fine cut in half.

Also, most court systems have some form of payment plans. Check with them on this.

I'm not rich, but if the fine is only $100, isn't that pretty cheap traffic-ticket-wise?

If you can't afford to pay it, just cut off your Internet connection for a few months.

I don't know how it is in the US, but in Canada i've gotten out of every single ticket i've been issued so far. Been issued a no seatbelt ticket (this was so idiotic, i was pulling INTO my parking lot when it happened), driving with the wrong plates on the car, and not having my insurance papers in the car with me.

All i did was show up, cop didn't show up, and the judge threw out the tickets. Simple as that. Now, if he does show up, then argue your case, because you have a very good point, you were only a few mins early at most... don't ask for dismissal, just ask him to cut the fine down.

Just show up early. Ask the prosecutor about the charges, and explain all to him/her some times they will dismiss charges but most times they will downgrade charges . A lesser charge might carry fine but no license/insurance points. I did this with my son and the judge wound up not agreeing with dismissal, wound up with bs charge and small fine but no points. Still was worth the time and trouble, the trooper wound up apoligizing to us afterwards. He said he wasn't gonna give out any similar tickets in that town again.

Here is what you need to do, or here is what I would personally do.

First of all, no need to hire an attorney for such silly case like that. You can do everything yourself. You know that you didn't violate any laws and most likely the cop who pulled you over was mistaken for time of the sign. Warrant for your arrest was issued because you didn't show up on your court day. That's a standard procedure in US Justice System. Where did you even come up with an idea of not showing to your court in order for your ticket to be dismissed? If US system would work this way, can you only imagine how many killers would be running around without ever being brought to justice?

Let's return to the main point though. What happened is happened and on December 26th you just need to go the court and simply explain to the judge what happened. If your ticket has a time stamp on it and if you'll tell the judge the same story you told us, your ticket will be dismissed without any problems. Just show up and don't make things more difficult for yourself.

Another thing you can do is show up to the court before your December 26th and schedule a hearing for your case with judge and prosecutor. Explain them the situation early, and by the time court day comes everyone will be ready. You will know what you're facing and prosecutor won't charge with unusual things by knowing your story ahead. Nobody likes sudden surprizes, including you.

<< Very hard, so you are pretty much arguing that you made a left turn before 7am and the officer had you until after 7am. Say that your clock was a little off, still what an anal officer to stop you for a minute or two. Police do have video tapes with "their" times, they can provide record on what time they said they stopped you, etc. I don't know how you can argue this case. How much is the ticket for something little like this?

My brother one time did something similar to do this. In court, he just said he apologizes and he didn't see the sign because something else caught his eye and they just dismissed him. No fee or anything.

How can we help on a little case like this anyways?

I had to argue with my teacher about my tardiness last year, because my clock was calibrated against atomic clock the day prior to it and I was not late according to this, but was late according to the school's clock. The communistic school system didn't buy my excuse and marked me TARDY anyway. I said Fvcking bit*h to the teacher and stayed in the office for that period.... sucks...

ok, all you have to do is get documentation on the procedeures of how often they set the correct time to their cameras. if you can prove that there is any possibility that the cameras are ever more than 2 minutes off, then you are ok, reasonable doubt.

I won't bother with court ever again... I had a ticket with the WRONG LOCATION on it - as in, it did not actually exist! (the "intersection" was actually 2 parallel roads with no intersecting points) and I thought FOR SURE i would win being as it didn't actually exist, my case comes up after 5 hours of waiting, and the cop is like yeah there was a mistake on the ticket and we're changing that now, or something retarded like that.. i left before the idiots could speak up and paid the fine.. bunch of asses.. I HATE THE LEGAL SYSTEM THEY ARE ALL A BUNCH OF PR!CKS!!!!!!! :| :| :|

i have had toooooooo many stupid things with the law and i have NO respect for police of judges or any of these scumbag losers... BOOOOOOO!!!!!! :| :| :|
