Wal-Mart spokesman Tom Williams acknowledged the incident and said the retailer is investigating.

"Snakes are kind of an act of God," he said.

Yea......that'll make the man NOT want to sue Walmart

Shouda gone to the sportin' goods department for a snakebite kit

Yeah, he has a great case. Walmart has great lawyers though. They will probably offer him lifetime discounts on the food grill, and a great big walmart cheer.

Wow, thanks for the story.

Does sound like a lawsuit coming, though as much money as Walmart has, they'll either get super duper lawyers and get out of it, or just pay him his pennies with no real impact financally.

Go Walmart!

Wow that really sucks. Sounds like my kind of luck... He should at least get a settlement cuz even as random as that is, Walmart was still 'negligent.'

While I know we are jaded by BS lawsuits, I think this guy has a case.

And I'm a business owner.

Walmart knew it had a problem with snakes, and even went so far as to issue snake repellent to it's stores.

The man was injured through absolutely no fault of his own and by no act of carelessness on his part on Walmart's property. The snake was an unassumed risk. Honestly, how many of you think "I better be careful of snakes" when in the garden department of your local megamart?

Walmart should be offering to cover all his medical bills and his lost wages now, instead of creating a PR nightmare by claiming BS like "act of god." They are going to pay either way. It would be better for them to come out smelling like a rose (a rose without a snake).
