Virtuallab locking other programs from scanning lost files?

I recently downloaded virtuallab.com's lame client that wants $100/GB to restore files.
I can not find the files using a traditional data recovery program (winternals disk commander).

Is anybody aware of any measures that this software takes to "lock out" the files from being scanned correctly?
