Since Clinton, the Dems have never been shy about trying to keep the military vote down - especially the absentee ballots which Dems never want counted. Now the state of virginia has argued that sending out a ballot with 1 day to go is good enough.


"The Virginia State Board of Elections argued in their most recent filing that they have no legal obligation to send out military absentee ballots in a timely manner. Restated, the State of Virginia has argued in a federal court filing that they can legally send out absentee ballots to active duty soldiers the day before an election. Restated again, theDemocratic Chairwoman of the Virginia State Board of Election (appointed by the Democratic National Committee Chair Tim Kaine, in his capacity as Virginia Governor) Jean Cunningham just claimed a legal basis for massively raising the barrier to voting for soldiers at war."

Now, did they decide that they "could," or that they "will" do this?

If they do indeed wait to send them out until the day before the election, that's seriously fucked up. :|

sounds like they're right on the law though. why does this even come up? if politicians weren't scumbags this wouldn't come up.

if they hadn't already sent out stuff way later than they ethically should have then there wouldn't be a lawsuit because there would be no actual case or controversy. so, i don't know if it's as short as the day before, because it doesn't say and i'm not willing to spend $0.08 a page looking around pacer, but it was probably too late for the ballots to get to where they were going.

This is a good idea. Those folk are fed a steady diet of Rush Limpbrow to make them fighting mean and they have no time to study the issues, being away killing people. They tend to pick donkeys to vote for just out of spite and they are mostly the Republican jackass kind.

Did you know that under Federal law, people that collect voter registration are not allowed to toss them out, even if they're fraudulent? The most the voter registration people can do is notify the public officials they hand them to that they suspect fraud.

Voter registration fraud != voting fraud

For the record, I'm not saying that ACORN is not engaging in other enterprises that are questionable. People are certainly getting their panties in a twist of ACORN though.

Pure and simple, anyone trying to disenfranchise troops that are serving overseas or anywhere away from their home of record needs to be removed from their taxpayer funded job immediately. By recall, impeachment or voting them out of office - throw the bums out and ban them from ever serving in a position of responsibility again.

I don't disagree, but that's not what this case is about. I suggest reading the actual brief filed by the Commonwealth of Virginia, rather than the sensationalist puff piece on which the OP is relying.

Virginia is stating that no law sets a deadline. It is the blogger and the OP that imply that "no deadline" means that they will mail things out 1 day before the election. That is quite a big jump in logic without any justification.

A short summary of what Virginia is actually arguing:

1) There isn't even an alegation that voters were prevented from voting (McCain-Palin didn't challenge this statement).

2) There is no federal law that specifies a deadline.

3) Only congress can pass a deadline. According to McCain-Palin's opening statement, congress actually is working on a deadline law so this whole thing might be a non-issue.

4) UOCAVA requires that all absentee ballot applications be processed if they are received at least 30 days before an election. But, McCain-Palin's argument that absentee ballots must be mailed at least 30 days before the election is unreasonable because "applications received exactly 30 days before an election would - under [McCain-Palin's] theory - mean that a State would have to receive, process, and mail UOCAVA ballots all on the same day".

No where does Virginia argue that 1 day is enough time. They are simply arguing that there is no deadline and that 30 days is unreasonable due to other laws.
