So this lady created internet porn (streaming), consensually with her husband. Sounds like up until she decided to run for office. Well of course people did it and noticed it was her.

Instead of just owning it and saying something "this is what we had to do to pay our student loans" or "my husband and I enjoyed being watched and as consenting adults there is nothing wrong with that." She is claiming illegal activities and sex crimes. I really don't care if she did/does porn, but it bugs me that she is claiming victimhood when she was the one her created the content for public consumption. This isn't revenge porn.

Also I'm posting it here just because I think it's interesting, not because i think it really matters. Except that she is probably going to alienate more voters by not just owning it.

I guess it's all in how she spins it, and her first instinct is wrong imho. I have no problem with it considering the current state of the GOP. Heck, I kind of grew up watching videos of Heather fund her way through college with her husband, she was in fact amazing.

"Gibson's attorney, Daniel P. Watkins, said that disseminating the videos is a violation of Virginia's revenge porn law, which makes it a crime to "maliciously" disseminate or sell nude or sexual images of another person with the intent to "coerce, harass, or intimidate."

They did livestream the videos, but I'm guessing they didn't upload the videos to the archive site a month after declaring candidacy?

It seems like we live in an uptight country due to the horrific after effects of puritanical/religious influence that has ruined the human experience in so many ways.

You have to assume live streams are going to be recorded. I think the article said they wereon the archive site before she announced, its just they've recently been found.

Regardless, is it really dissemination when it's already been publicly released by the peopt in the videos?

I’m very curious about how the law works in a case like this. As someone familiar with streaming sites like the one Gibson used, I believe permission may be granted to view the livestream but not to record or disseminate recordings of the stream—that remains the sole right of the creator for them to monetize or not however they see fit.

That being said, it’s not rocket science for anyone viewing to record the decrypted livestream as raw video and manipulate or host it however they see fit. Many of the site’s creators/streamers will broadcast with a visible “DMCA” banner to facilitate takedown requests for that reason.

Now if Ms. Gibson is alleging that she and her husband never authorized recording or released any of their recorded sessions, she may have a case. But good luck finding the owner/host of “Recurbate” and serving them with papers—nevermind whomever recorded or uploaded the videos in the first place.

The way I read it is that it's the intent behind it, if you're just distributing it as "general purpose wanking material", that's different than "disseminating to harass" a political rival. Seems like that might be tough to prove in this case though. I'm just saying that simply because they knowingly made the content available to some parties doesn't remove the possibility of the same content being used as "revenge porn".

I think you'd have a really hard time winning that case. Basically saying content that was widely available to the public is fine for wanking but not for "questioning the morality" of a politician.

I sometimes wonder how fucked this country will be in 10-15 years when today's dumbass millenials and gen z's old online pornography comes up to spite them. I recall reading about people getting on the amateur pornography bandwagon during the pandemic. It's only a matter of time until we have a president who did porn.

I've been involved in the swinging scene and ENM scene on and off around here. Always looking for something long-term, but having fun in the meantime.

I have met couples and partnered people from all walks of life: doctors, teachers, business people, self-employed, blue collar, whatever. And let me tell you, being non vanilla sexually is really damn common. It's a shame the religious conservatives over the years have destroyed this healthy part of the human experience and turned into this sinful taboo thing where we still feel so much embarrassment and shame about it.

That's no the argument I see, the argument I see is "did someone maliciously distribute this with the specific intent of harassment?". Whether it's available (widely? IDK, how widely available are these porn livestreams, I have no knowledge in this arena...) outside of that wouldn't strike me as relevant in whether or not someone violated the revenge porn concept.

When you judge Republicans you scream about how dangerous they are and how we all need to come down on them. What religious puritanical inner moral standards are you using to make that consideration, or is that something you see as completely different.

I'm not endorsing all porn. Mainstream porn has a lot of negative effects. But not some amateurs having some exhibitionist fun. And the way you demonize sex is absolutely horrific for the human condition.
