This just makes me sad. Reminds me of all of that stuff about telling women not to get mammograms early.

Legal news for New York Medical Malpractice attorneys–A war veteran was denied a colonoscopy when he had colon cancer, which caused him to file a lawsuit against hospital.

Buffalo, NY (NewYorkInjuryNews.com) – A local war veteran is suing a New York VA hospital after being denied a colonoscopy, when he had a history of colon cancer, according to WIVB, on December 3, 2009.

The veteran, David Cohen, found out later that the hospitals rejection may have put him in a situation where cancer may claim this man’s life. The patriot, who proudly fought for his country in the U.S. Navy, now fights a personal battle of colon cancer.

Cohen was diagnosed with stage four colorectal cancer in August 2009 in Buffalo’s VA hospital. He said that his history of colon cancer began with his grandmother, along with several other family members. Cohen, knowing that this deadly type of cancer ran in his bloodline, requested a colonoscopy and was denied several times.

Cohen’s prognosis states that he only has 26 months to live, but he plans on surpassing that time frame. He now shares the simple message with all people he meets that they should not take no for an answer and to go with your gut. Cohen filed a lawsuit against the VA hospital.

According to the CNN report, he was asking for screenings as early as 2003 :(

Who runs the VA healthcare system?
not the government per say, but health care companies, like Valor Healthcare Inc. of Washington, D.C. who bid on VA clinic contracts and are awarded them based on pay offs. : /

If I had his family history, I would have paid for the screenings myself and then sued for reimbursement. Going without the screenings simply because someone else wouldn't pay for them seems stupid in this case.

I fairly certain that the Department of Veterans Affairs, specifically the Veterans Health Administration, is responsible for all health care in the system, making it government run. I'm sure there are government contractors, but it is still government run.

my wife's grandpa is a vet and he doesnt like the VA system at all. He avoids them whenever he can

Yep. They didn't say he COULDN'T get one. Just that they wouldn't provide it. If he wanted one, he could have gone anywhere and paid for it himself. All the free market types on here should be thrilled.

Just like all the mammogram hype. If these chicks want to pay for their own, it's a free country and they are more than welcome to. Don't expect your insurance company or the gov't to pay for every test under the sun whenever you want it if you're not at high risk.
