Validity of OEM Software

Due to the Business Software Alliance crackdown in Chicago I need to perform a software audit. I was wondering is purchasing OEM software a legally accepted way of obtaining licenses? We are pretty stringent around here but things do fall through the cracks. I just find it outrageous that Office 2000 is $400 retail, $120 OEM.
 
I might be wrong but I think the only valid way to buy OEM software is with a new computer system. I'm sure Microsoft would have info about this on their website.
