in August, Peirce and Hoagland welcomed a 1-year-old girl into their home, where she joined the couple’s two biological children. Plans for adoption, approved by the infant’s biological mother, were in place — soon, this would be a family of five.

But Wednesday, a Utah judge decided to end this plan, ordering the girl removed from her foster home because the child would be better off with heterosexual parents, he said.

Though they had yet to see Johansen’s order as the couple talked to the media, Utah child services was in a bit of a pickle. On one hand, they won’t be able to ignore the order. On the other hand, it may not be a legal one.

“On the one hand, I’m not going to expect my caseworkers to violate a court order,” Brent Platt, director of the Utah’s Division of Child and Family Services (DCFS), said, “but on the other hand I’m not going to expect my caseworkers to violate the law.”

Indeed, Johansen seemed to be the only obstacle to a resolution everyone else wants.

“We have a lot of support,” Peirce told the Tribune. “DCFS wants us to have the child, the Guardian Ad Litem [a court-appointed representative for the child] wants us to have the child, the mother wants us to have the child, so the only thing standing in the way is the judge.”

Johansen said “through his research he had found out that kids in homosexual homes don’t do as well as they do in heterosexual homes.” She added that, when the judge was asked to show the research, he wouldn’t.

The bigot needs to be removed from court if he is going to be making these kinds of decisions based on his own, secret research which likely fails any sort of legitimacy test. Nothing like having your personal, biased views getting in the way of a fair and balanced court system

the part about 2 lesbians already having 2 biological children made me go WTF. makes it sound like the child is biologically both of theirs when that's obviously not possible. i guess maybe each of them got artificially inseminated or something?

while i don't agree with this judge doing this, i think there is something to be said about children growing up with 2 parents of the same gender. that child is going to be teased to shit their entire youth, constantly being the punching bag of jokes.

It's also possible that either or both women had children with a man before coming to accept their sexuality.

And while it's possible a child of 2 women will get teased, why is that the fault of the women? It's the fault of the shitty parents of the children doing the teasing for not raising their kids right.

Wait - did someone actually expect a conservatard to provide proof of whatever claim he/she is making? I mean, we are well beyond trusting ANY source a conservative produces, or even providing one.

I'd need more info as to what the house is like. I do believe a start home gay or hetero is best. I do believe a traditional man & woman couple is best but that doesn't mean move kids around when a hetero household is open.

As for the people complaining about "a fair and balanced (oh the irony of them wanting a balance when they want people removed because they hold a different opinion of same sex parents) justice system", in order to have one, you cannot advocate the removal of individuals who hold a different opinion of what's the best way for kids to be raised.

A judge can not and should not be breaking the law on the bench. when they do they should be removed from the bench.

What I'm curious about is what rights does the one year old child have and how that factors into what's going on with this situation, especially over long term consequences that the child will have to live through.

i never said it was the women's fault the child will be teased, but it IS their fault because it was their selfishness to want to bring a child into their homosexual household. it wasn't like they accidentally had a kid.

IF he ruled Lesbian couples were better suited then it really wouldn't matter in this case. There wouldn't have been any discrimination.

it's not just his opinion on the sexuality of the parents he is free to have any opinion he wants. it's the fact he discriminated against them due to the sexuality. that is against federal law. as a judge he should uphold the law and he failed to do that. he should be removed from the bench.

One set of people want the ability to live their lives without outside influences telling them what they can and can not do that has no bearing or impact on others. The other set (the ones people want removed) wants to tell people how to live their lives and what they can and can not do that has no impact on the lives of others.

In this case this judge claims it will be damaging to the child but offers nothing to support that claim. He refuses to support it with any factual analysis that he claims to have used.
