...after reading this a couple of times on slashdot I got to thinking...
...maybe the justice dept. wants to have the DMCA taken to a high enough level to be deemed unjust and abolished. Sklyarov just happened to be the unlucky one who has to take the abuse.
If he were let out now the DMCA would remain unchallenged.
