Weds 2/14/07 Morning So I bought this from here. (Site is a little slow give the page 15 seconds to load.) LINK Notice the bright yellow Howards Shopping Guarantee notice.

I did some very light searching and it seemed they were ok with user reviews. Any deep searching proves otherwise.

So anyway I bought the amp, it arrived yesterday and does not work. Sound cuts in and out. I have other amps hooked up to the same devices so I know it's the amp.

I call them up and they say, you have to call YAMAHA they will service it under the warranty.

I call Yamaha and they say where I bought it from is not an authorized dealer so I voided my warranty.

I call HPDIRECTAV backup and tell them what Yamaha said they say oh yea there is no warranty, we sell them cheap and Yamaha does not like that so they do the no warrenty thing, try to get a manager and maybe you can get Yamaha to fix it. Tell them you got it as a present, a lie. Bottom line, Yamaha won't fix it.

So I ask them about the yellow notice that I linked to at the beginning of my post. They say that doesn't apply to some things at their site....

So I am thinking about complaining to the BBB but I went threw another fake transaction to make sure I didn?t miss anything. Right before you order there is this little box that you have to agree with 3 pages of scrollable text. In that text they state that I could buy a broken item and they don't have to do anything about it pretty much and I can't return it.

So now I am off to pay to get a brand new broken receiver fixed.

Like I said I should have read the fine print.

Oh yea stay away from these guys too. They also charged me for 2 day shipping 50$ but shipped it ground.....

Guess this is a life learning lession. I didn't see there main page on the web untill now talk about cheesy.

Weds 2/14/07 Late Morning UPDATE: So it was charged to my CC. Reading further into the fine print it says that the purchaser will be responsible for product defect return shipping cost if the store decides to take it back. It also says that the buyer is agreeing to never dispute a charge that this place puts on my Credit Card. IS THAT LEGAL? If someone wants me to post the fine print I can....

Weds 2/14/07 Afternoon I spoke with my CC company and they said that I could do a charge back and get the full amount back if I followed their instructions. Strangely I just got an email from HPDIRECTAV giving me authorization to return the product. I am not sure what I am going to do yet because through the CC I am guaranteed all my money back but through HPDIRECTAV and what their small print says I may not get all my money back. This morning they said they would not take it back and now this email shows up with no explanation.... kind of strange.

Friday 3/09/07 Afternoon Long story short, I took the amp to a repair place to see if it was worth getting fixed at the beginning of all this since no one seemed to want to take the amp back, anyway the repair place called the HPDirect people and let them know what they were doing was wrong, that's why I got the return authorization from HPDirect. But the Yamaha repair place worked something out between Yamaha and HPDirect to get the whole thing covered. So I got it back today in working condition, yay. Thanks again for the advice if the repair place had not gone the extra mile, respect to them, My CHASE CC let me know they could do a charge back I would have never though of doing the charge back if you guys hadn?t told me about that option Thanks.

I would report them to the BBB regardless. An EULA only does so much in covering up a shady business practice, it doesn't give them free reign to break consumer laws. I would also dispute the charge with your credit card company, and leave a nasty remark about them on resellerratings.com.

Tell them you want to return it for a full refund. They'll refuse.

Dispute it with your credit card company.

Edit: Tell them you want them to send you a pre-paid shipping label so you don't have to pay to return it.

WTF is the BBB going to do? NOTHING!!!! the only companies who care about the BBB are companies who are MEMBERS of it.

the only course you have is to call your credit card company and tell them what happend and dispute the charges.

As mentioned the BBB is a waste of time.

Contact your CC company and if you are pissed enough contact your statess AG.

That type of fine-print doesn't ALWAYS excuse a retailer.

Are you located in NYC? I know some good places to get it repaired at a half-way decent price.

How about you call up the CC company and find out what they want to do? You could end up getting your money back and getting to keep the broken amp (which you can then get fixed).

You seem to be compounding your mistakes with further mistakes. First mistake was to buy from such a shady place, especially after seeing a horribly amateurish site.

Then, when they tried to rip you off, your first answer should have been "I want a full refund and a shipping label, or I will simply do a chargeback through my CC company". Next, you file a complaint with the state attorney general of NY, and you fill out a nice review on every review site (like resellerratings) there is.

Done. Worst case scenario, you might be out the money to pay for shipping the junk back to them.

Trust me on this one, credit card companies can be pretty crooked themselves, but in a scenario like this they are your best friend, they give you the power to give those guys the finger and say "I'm not getting ripped off by you".

Well I see this on that page:

All products we carry are Brand New, Factory Sealed, complete with All factory supplied accessories, and a full manufacturer's USA warranty.

So what am I missing in this thread?

They are not an authorized reseller = no warranty = Fraudulant claim on their site regardless of whatever their return policy may be.

If you can't get a refund from your cc company then try to get Yamaha's policy on this in writing, a screenshot of that statement I quoted, and make a civil case out of it against the place you purchased the product from. I know it sounds like an uncertain way getting your money back but I believe that there is an extreme chance of you getting refunded any and all costs the very day a summons is delivered to them.

Of course a dispute with the cc company is the first and best route but personally I would jump to the latter option just to be an a$$. :evil:

While generally I detest CC companies as a whole, there are times they have been my very best friend!

Which reminds me, I have to go down to the bank and file a chargeback after work today.
