UPDATE!!!! EXTRA HELP NEEDED Help please with ebay seller

I have ordered a 128mb CF card off of ebay for what I had thought was a good price. the Auction ended 12/24/02. I went ahead and paid for it right then and there 5 minutes after I won the auction.

3 days later I have yet to hear from the seller, so I decided to go ahead and email him. About midnight I finally recieve a generic response and a response directly from him. The first one said he was going on vacation and anyone who won auctions he would ship out on the 30th. And the one I got directly from him stated he would have a friend ship it out while he was gone.

on 12/30/02 after not hearing from him again I decided to email him again, and I finally get that response the following day. He would ship it out the next day.

Now it's almost 1/4/03 and have paid for my item 10 days ago and I assume it has not been shipped out because I have not recieved anything from him and he has not replied to my emails.

The last email I sent him I stated that if he doesn't respond I would submit it to the proper ebay / paypal fraud depts.

Am I just being too hasty? should I give him some more time, or should I just send it in to paypal and get my money back? Most auctions that I have bought stuff off of ebay they sent out within 2-3 days after the auction and if they didn't they would email me once it was shipped out with a tracking number.




UPDATE: ok I finally got it 1/6 2 weeks later... but I got it and it was in two pieces (It was damaged in a way that it couldn't have been shipping, because the packaging around it was fine, and it was a pretty clean cut). I was pretty mad at this situation so I left negative feedback... although he offered to correct I let him know, I may have another solution to get it fixed faster... but I was gonna post a follow up stating he offered to fix it




UPDATE: after talking to a couple of other buyers from this guy he has sent broken lexar memory to everyone. And one of them was going to have lexar replace it for them but he is breaking them apart and replacing them with a broken 4mb Sandisk brand CF chip. so essentially he is ripping hundreds of people off. What can I do.. I have already filed a fraud report with Paypal to try to get my money back. but I can't do anything with ebay till 30 days have past :(

How many BUSINESS days have transpired since you sent payment. While I agree all auctions should be settled quickly, this is a tough time of the year as far as shipping items goes.

he is probably still waiting for the cf from staples that he got for 30$ after rebate. ;)

I ordered a car stereo on Ebay last Wednesday. It arrived in the mail on Saturday...I was surprised because it came from 4 states away and was only shipped priority mail from the USPS.


Keep in mind that patience might be the key here. I like to think there are more honest people out there than dishonest people. Give him until the end of this week. If he's already shipped it, he certainly can't help the situation. Ask him how he plans on shipping it and get a tracking number...

I have tried to warn as many people as possible about him (all the high bidders on his auctions) but there are too many and new high bidders just keep popping up, so it's a full time job doing that

unfortunetly the auction says returned item, untested and as is. If you wanted something guranteed to work, you should not have bought the item. Also it appears that the seller already had a lot of negative feedback before you purchased complaining about the same thing you complain about slow shipping, broken items. What did you expect?

It would have let it all go if I had recieved a non working lexar CF card (which your right it does say as-is), what I recieved wasn't even what I paid for. I am talking to 6 other people which he has ripped off this way. He sent me a non working 4 meg Sandisk card

well if it was the wrong item, you have justification to be unhappy. I refuse to buy of sellers with a lot of complaints even if the deal is great and have not had any problems yet.

So if he sends you a nonworking lexar card everything will be ok :)
