So about 2 hrs earlier this afternoon, some lady rammed into the side of my car and asked that I dont call the cops. The funny thing is, she wants to settle it w/o the cops and insurance company and asked if I was willig to pay for the damages?! I'm like no way so I called the cops. Turns out it wasnt her car (it was a friends) and the car had its insurance cancelled. So, now I sit and wait to here what will happen now.

She said I ran through the stop sign but the cop even acknowledge that the damage to my car looked like she was at fault since she hit the side of my bumper (in front of the tire) while the front of her car had slight damages to it. Good thing is I have uninsured motorist coverage. I need a new car so hopefully I can get a check and go buy a new car anyways. The transmission and oil are leaking way before this accident! :(

I have State Farm, I wonder if they cut you a check or do they pay the body shop personally after the estimates are in?

If she has insurance it should cover her for driving her friend's car, no?

& state farm looks at it gets an estimate then writes you a check.

I don't think it works that way. I mean, what if she has insurance on a tiny dodge neon and she hops into someone's huge dodge ram and hits a car?
Her insurance covers her vehicle. It's why she pays less to insure a dodge neon than a huge truck.

Her insurance not only covers her, but her vehicle. It's why she pays less to insure a dodge neon than a huge truck.

My insurance covers incidental driving of other cars. As long as it's an occasional thing then it's no problem. If I'm driving the car weekly or daily then I have to add it to the policy.

Don't some people have insurance for riding in other cars?

I am under my parent's insurance so I didn't do the paperwork, but they always told me if I was to rent a car that I wouldn't have to buy the rental insurance because my insurance already covers me.

Hmmm ... she was saying how I could go to a mechanic that works with them and SF would pay the shop directly. So, if it turns out that I win (i dont see why i wouldnt) should I say I'm taking it elsewhere or just give me the money for the estimate and I go get a new car? The car isnt worth fixing due to many other issues.

I got into an accident 2 days ago (first ever). Some guy was reversing to give SUPER EXTRA space to someone backing out of a parking spot. I saw it coming 3 seconds away so i LAAAAAIIIIIDDDDD on my horn for a good 2.5 seconds. He still backed into me. I pulled into a parking spot, was amazed that there was 0 damage and sent him on his way. A nice middle-age man who made an honest mistake. If it had been some kid, I woulda been all over that.

I'm not sure if this is legally insurance fraud but...

You can get 3 separate estimates from local body shops for the damage. Give the highest one to SF, get a check cut and just never get the damage fixed.

Yea, had it been minor I wouldve said forget about the whole thing. It kills me when they both said "dont get the cops involved but u know u will be paying for this."

Now, the guy who was a passenger in the car apparently lives in the area and he knows ppl on the block. It better not get far and start calling witnesses and stuff. I'm banking on the fact that she has no insurance and she's driving her friends car and the position of the damages show they she collided into me. Had I run the stop sign like she insisted, I think I wouldve hit her on her side.

Yea, thats what I'm hoping for. But if they say I need to put money out first or that they pay the body shop once repairs are done, then I can't do anything about it. Now if they say they give me a check then I just wont get it fixed.

What kind of car is it? If old / not worth much (sounds like it), the body damage may be enough to total it out. Even minor body work is very expensive. I've owned cars that would have been totalled from a door ding :p

With my insurance, I can drive other cars if I am given permission (not rentals AFAIK, but if I borrowed a friends car I would be covered by my insurance). It's stated explicitly in my policy, although this nice lady might not have any insurance, so it wouldn't matter anyway, but you can be insured for another car by your own insurance.

If that was the case I could insure myself on a Yugo and then hop in a Lamborghini and expect them to cover me if I live through it. Insurance follows the vehicle, NOT the driver.

And while some policies say you will be covered while driving someone else's vehicle, if that vehicle is uninsured, you are operating it illegally; and I'm pretty sure they would deny coverage based on that premise.

OP, if you have collision coverage on your vehicle, your insurance company will fix the car for you unless the cost exceeds the fair market value; in which case they will total the vehicle and write you a check.
If you do not have collision coverage, but only liability coverage, you must go through the other person's insurance company to get your property damage taken care of.

Since the other vehicle is uninsured, you must file an Uninsured Motorist claim with your insurance company. They will then fix your vehicle and pay any medical expenses through that claim, provided they determine the other driver is at fault.

i ran into a wall the other day, and since i have full coverage and wanted to get rid of my car anyways, made the claim. i was wavering about whether i wanted to get it fixed or not, so the insurance agent just cut me a check. i told her i wanted to sell the car and i probably would not make the repairs, so i got the amount minus my deductible.

who knows how it goes on someone else's insurance though.

Your comprehensive/collision coverage applies to cover the damage to your car. Your insurance company will chase her for what it pays you (likely via small claims court).

Uninsured motorist coverage is to cover bodily injury resulting from an accident that is the fault of an uninsured driver.

What I'm saying is that the person who hit the op potentially has no vehicle & therefore does not have car insurance, thus making the car that hit the OP totally uninsured. Poor people in the ghetto often let neighbors and friends borrow their cars in exchange for favors/money.
