Uninsured driver

So about three weeks ago I was in a car accident. I was driving down the street with no stop sign, she was coming down an intersecting street and had a stop sign. She pulled out anyway, I hit her in the side. I immediately called my insurance company and asked them what to do, they told me I did not need to file a police report unless I really wanted to, and I filed a claim with them right then. now, I don't have collision so they aren't going to pay for the damages, but its not my fault so it shouldn't matter anyway. She had a current insurance card, so I took her all her information down.

So, I've been on the other side of an accident, so I was trying to be civil about everything. She asked if she could pay for the damages herself so her insurance goes up. I said that's fine with me if she really wants to. I got an estimate, called her, and she hasn't responded since. So I figure fine, I'll file a claim with her insurance. I call them up...oh, turns out she canceled her policy in May and has just been toting around the card pretending it was still current.

This is great. I hope Progressive lets me sue the sh!t out of her with their lawyers.

IMO comprehensive coverage is a must.

To many uninsured drivers out there.

My Mom would have had to pay to have their car basically rebuilt if it wasn't for her comprehensive coverage.

But I guess if you can't swing the monthly for it then the only other option is taking the risk.

Good luck with getting it covered though.

Always file a police report. Always call the police to see if they will come out and write it up. She'd get busted for driving uninsured if you had, and you'd have good evidence to take with you to court.

You're probably going to have to go to small claims court over this. :(

I lost a car to an uninsured driver with a suspended licence. Oh yeah, and he was drunk. No one could put him in the vehicle though since it was parked when the ba$tard hit it.

Sucks man. :(

We had someone hit our car and push us into a truck and then drive off. I was so pissed... but then two hours later just as they were putting the car on the flat bed and we were getting ready to leave the other driver came back (or at least someone came back in the van that hit us, something tells me the frail lady in a skirt wasn't driving the work van with ladder racks when it hit us)

Sorry but since you dont have collision, what does your insurance company care if she pays you or not?

Well my agent said they would help me in getting money from her.

As far as the police report - yea, seems now that would have been best. I don't know why the guy I talked to on the phone said I didn't need one.

As far as proof - my agent was also going to call her to get a statement back when she was still communicating with me. Assuming he did, then she's already admitted to it. Plus, there were witnesses. I didn't get their names but I saw which house they went into, so I'm sure I could track down at least one.

She was driving a 1990 chevy lumina with no insurance in west philadelphia. You make your own judgements about her financial situation....

It doesn't really matter, there are lots of options like filing a lien on her house if she owns it, or in the worst case scenario garnishing her wages.

You should still call the police to report it. The limitation for such charges isn't 30 minutes... they can easily charge her a month or so afterward, provided you give them sufficient proof.

I thought you could get "uninsured motorist" coverage on your vehicle (rather than comprehensive)? i.e. not pay for comprehensive because you're relying on your own driving ability to not be at fault in an accident. (Not that it'll save you when a deer jumps in front of you.)

Yeah, I don't get how progressive would assist with their lawyers in this.

Go down to the police dept and file a complaint for somebody driving without insurance. btw really dumb of you not to get a police report. I thought most states required one if the damages were more than 500 bucks?

You don't need a 'report', you still need to call the police. Always call the police in an accident. Especially if you know you may be at fault...all it takes is the other guy to call the police and say you fled the scene.

Insurance is such a scam. I firmly believe insurance should be non-mandatory, and should ONLY cover the policyholder's car.

That sux, and you're probably screwed for getting any compensation for your vehicle.

We have a plague of uninsured/unlicenced/unskilled drivers here, and as was mentioned several posts ago, MANY of them simply disappear back across the border if they have a serious accident to avoid responsibility/prosecution. No wonder Kahleeforneeya has such high insurance rates...

Even if insurance were optional, she committed both a crime and a tort. Were it not for insurance to protect her I could sue her. Oh, kinda like I can (and will) do now.

As for the police report - yea, I already said I should have, but progressive told me not to. I assumed that progressive knew what they were talking about. At any rate, I will sue her whether progressive gives me a lawyer or not, I will win, and I will either get compensated or put her ass out on the street.
