Unemployment Appeals Process

Long story short, wife got layed off from her job at an Escrow Company. They let her go for obvious lack of work. She tried to claim unemployment and they denied it claiming that she royally sucked at her job....even though they had employed her for 4 years and her last review was super positive. We appealed and won, they had no actual evidence. It was all "he said, she said" type of stuff. No documentation. They also never showed up for the appeals hearing instead choosing to give a written statement.

Now we find they are appealing the Appeal. I'm just wondering if anyone has any experience with something like this. These guys are just lying now. They submitted a written statement saying that everything my wife said in the Appeals hearing was a lie. But they still have no documentation on any of the claims they are making. I'm thinking they're just wasting their time but wanted to know if anyone here has experience in this. I know times are tough for companies in the Real Estate biz but that doesn't mean they should screw they're once loyal employees.

If they have no new documentation then I wouldn't worry about it.

I am not sure about the appeals process, but I imagine it will be thrown out. I know in the past when I was laid off from a job, they appealed and tried to say it was because I was unable to perform the job duties. The board basically told them to stuff it, and said that 'inability to perform the job duties required was not sufficient grounds for denial of unemployment insurance' - i.e. 'If you as a company are foolish enough to hire someone unqualified for the position you are filling, that is your mistake - pay the man.' Never once did they get into whether anything said was true or not, so not sure how that will play out for you.

If they don't have any documentation to support their claims, don't worry about it. I regularly "do battle" with unemployment claims on the employer's side, and it is heavily weighted in the claimants favor. Without mounds of supporting documentation, employers rarely escape.
