Official: U.S. to seek death penalty for 6 Gitmo detainees

WASHINGTON (CNN) -- The United States will seek the death penalty against six Guantanamo Bay detainees who are suspects in the September 11, 2001, terrorist attacks, a senior U.S. official said.

The government is expected to announce Monday that it will submit criminal charges against the detainees, which include alleged 9/11 mastermind Khalid Sheikh Mohammed, according to the official.

The official spoke on condition of anonymity because the government has not made an official announcement.

All six suspects are accused of helping plan the attacks on the World Trade Center in New York and the Pentagon in Washington, the official said.

The New York Times quoted an official familiar with the case as saying that the other five detainees expected to be charged are: Mohammed al-Qahtani, the so-called 20th hijacker in the 9/11 attacks; Ramzi bin al-Shibh, accused of being an intermediary between the hijackers and al Qaeda leaders; Ali Abd al-Aziz Ali, who has been identified as Mohammed's lieutenant; al-Baluchi's alleged assistant, Mustafa Ahmed al-Hawsawi; and Walid bin Attash, who is accused of selecting and training some hijackers.

Wait, I thought OBL was the "mastermind"?

Are they going to be tried then executed? Or are they going to skip the courts and go directly to executed? Will these people have a defense? A lawyer? A means to submit evidence proving their innocence?

We all know innocent until proven guilty is gone, and has gone to guilty until proven innocent, but really, isn't that unfair, the innocent don't end up in jail to begin with.

I heard they were being strapped onto missiles and shot into terrorist training camps in the Middle East

Osama is a spiritual leader and figure head. I don?t think he is involved in the planning of operations.

If the USA has good evidence to show they were involved in the planning of 911, they should grant them a FAIR trial that passes international muster. And then if the verdict is guilty beyond all reasonable doubt and the larger world agrees it a fair conclusion, the death penalty may be warranted as a final end.

The problem with prior US policy has been.

1. Leaving those suspected in a limbo for many years when our constitution principles demand a fair and speedy trial.

2. A Total unwillingness to grant suspects a fair trial. If these are viewed as kangaroo courts, we will be seen as little better than those we executed.

I wonder if we'll ever get to see this evidence they have against them, will even the transcripts from the trial be available to the public. I don't expect this will be like the OJ trial, but it should be the most publicly open trial ever. I doubt we'll see any thing but some guilty verdicts.

I am guessing that a lot of the evidence has to be protected, especially the means in which it was gathered.

The best we can hope for is outside observers to sit in and watch.

If you are against the death penalty then it is definitely not fucked up. But then again, nobody in their right mind could be against the death penalty right?
