In yesterday's Sunday funnies, Doonesbury creator Gary Trudeau uses a character playing Trump's golf caddy to pose a very interesting question.

CADDY: Boss, have you figured out a workaround to the 22nd Amendment?

TRUMP: What are you talking about?
CADDY: The 22nd Amendment says no one can be elected more than twice...
Which means that to run again, you'd have to admit you lost in '20.
TRUMP: What? That's insane!
CADDY: It's in the Constitution, sir.
TRUMP: My Congress will repeal it! 22 amendments are way too many anyway! It's oppressive!
CADDY: 27, actually.

TRUMP: Oh, please! How does an immigrant like you know anything about the Constitution?
CADDY: My citizenship test. I had to read it.
TRUMP: More tyranny!

No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of President more than once.

Smart observation but irrelevant to the point. The former President was not sworn in for the “Second” term that he didn’t win. Even with his baby face talk about “winning” the election.

Trump will NEVER admit he lost anything. Therefore he can't/won't run.

Technically in his mind he didn't lose, it was "stolen", therefore he gets another chance.

Trudeau is quite literally correct. 22A says:

No person shall be elected to the office of the President more than twice,
and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once.

Of course he can legally be elected again, because he was only "elected" once. Trudeau was just making a joke suggesting Trump would have to admit something he refuses to admit.

Here is the actual reason he can't be elected again.

No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

Nah, I think Trump is perfectly happy to claim that he won the 2020 election and that he was cheated out of it, exactly up until a hypothetical point that he has to assert that he didn't win that election, then after that point he'll go back to his previous position, all without his supporters even skipping a beat or doubting anything.

If Trump runs in 2024, here is what we know for sure.
*The VP pick can't be from the state of Florida because it is written in the constitution that an elector can not choose two candidates from the same state. Thus no Trump DeSantis in 2024.
*Would probably not be a female, otherwise he would loose some support from his male chavonists.
*Must be hard against immigration, and belives that the election was stolen.
*Must not be a RINO.

The only people that I can think of are, Perdue (if he looses the Georgia gubernatorial primary or general race), Allen West (in hopes that African Americans would give him votes), Rand Paul, Joe Arpaio (Trump's perfect fit, but was barred from getting involved with borders).

I would assume a conviction for the crime of insurrection or sedition is required.

Unknown. I don't think there is a developed doctrine on that particular provision. But when Trump was impeached that second time, some democrats were thinking a conviction in the Senate with a written decision worded to track that provision would have precluded Trump from running again. But as we all know, that didn't happen.
