Trouble overclocking E8400 on p45 DS3L

I've been trying to overclock my new e8400 on a gigabyte ep45 ds3l, and having trouble getting into windows. I've tried many things including turning off c1e, EIST, and thermal probe 2.

I have successfully got into windows and orthos stable at 3.3 with 9x366 with ram running 5:6 (439 mhz, 5-5-5-15 @ 2.0 volts), but cannot get into windows at 9x400 at 1:1 (400 mhz 2.0 volts 5-5-5-15). I have tried giving more voltage to the processor and MCH, using turbo and standard modes, have fiddled around quite a bit really and with no luck. I get to the windows loading bar and that's it, black screen indefinitely.

It seems to be these are not terribly aggressive settings and I dont see why they are not working. Hardware is:

E8400 with thermalright tower and 120mm vantec fan (temps are 50c load at 3.3)
G.skill 2x2gb ddr2-800
Gigabyte EP45 DS3L
700W OCZ gamestream powersupply
Radeon 4870 with Hr-03 cooler
HT Omega Striker 7.1 sound card
Antec Three Hundred case (lots of cooling)

Any help here would be much obliged cus I'm really puzzled with whats going on here.

maybe that's all it will do... sometimes the slower chips are binned slower for a reason...

cut the memory speed way back and try a again...

Make sure you set the FSB strap to 400MHz, when running the FSB at 400MHz or higher. I had the same problem, when it was just set to AUTO.
