Trouble copying HD to another

I have bought a new HD and it shows up as 37.28Gb. The old HD shows as 38.34Gb.
I have tried using Drive Copy to copy everything on old HD to new but because they are different sizes it will not let me.
Unfortunately, I have the single partitiion using the full 38.34Gb on old HD.

sorry to state the obvious but you can't really expect to fit 38.34Gb of data onto a 37.28Gb of hdd, can you?
 
Its okay, I was curious whether Windows XP was clever enough to mess about with partitions.
I have aquired Partition Magic which does the job.
