This is my friends side of the story:
Okay, so.


As many of you know, I just bought a beast of a new camera, and I paid quite a pretty penny for it as well ($600). And I got this for a little more than half price. So anyways, me and my friend went out on the night of the 29th to an industrial construction site and we took all of our camera equipment with us. The complex was pretty big and only the skeleton of the struction has been built. No detailing has been done, and almost no electrical, except for few and far between lights, were up. We were looking to take low light shots with very long shutter speeds. If you know anything about shutter speeds, then you know you need very specific lighting conditions as to not over-expose the shot. Anyways, we were about an hour into shooting/exploring when alfa147x sees a ***ett Police unit pull into the lot and stop at my car, which just so happens to have been the only one in the lot. So we're like, oh crap. A few quick thoughts run through my head, and I knew we couldn't run and hide, because they see my car, and they KNOW someone's inside. So I put my lenscap on and I walk outside to the approaching officers and identify myself. I tell him what we're doing, and long story short, we end up in Hand Cuffs about six minutes later.

The charge - Loitering / Prowling

Wtf. THATS NOT ALL

He could have let us go and been like, Guys, seriously, yall need to leave. But no, he had to be a little dick about it and go show off "Department Policy and Procedure" in front of his brand new, fresh-out-of-the-academy trainee.

Then he searched my car and found a credit card that I had found at a gas station months before. To explain, I found an old lady's Credit Card at the Kroger Gas Station at Suwanee Dam and Peactree Industrial. I tried to turn the card in, but they didn't want it, so I called the number on the back of the card and made sure the account was closed. I know how these days people get screwed with Credit Fraud, so it was in fact already closed, so I just put it in my center console and forgot about it. I have never tried to use the card for any reason whatsoever as well.

Anwyays, he finds the card and he's like "Wtf" So he asks me about it and I tell him the truth. Even after tell him, he decides to tack on another bullshit charge. This one was a felony.

FELONY THEFT OF LOST/MISLAID PROPERTY.

To shorten this story, me and my friend were obviously in the wrong place at the wrong time. My bond, with fees, was a little over $5,000. Luckily, we used a bondsman and I got out on only $512 bail. I spent almost 12 hours in jail. This pretty much ruins my future in Criminal Justice - what I've always wanted to do since I was old enough to remember and watch the tv show COPS. This also ruins my chances to join the Armed Services anytime soon, which is also a dream of mine. Hopefully I can get this bogus bullshit dropped, because we're hiring an Attorney to fight this.

So this is why I went to jail. And yes, I smiled in my Mugshot, because this is so much BS.


I did not get charged with the felony, i did have to pay 2800$ bail

they have both of ours CF cards...
I did for some odd reason have my 75 - 300 F\4 even though i didnt need it...
I dont have a criminal record, a clean discipline record at school so we are thinking the judge might drop the charge...

I know it was stupid....

That's why I live in constant fear of others and eschew human contact of any kind. I don't even talk to my neighbor. Might be a serial killer. Or a Jehovah's Witness even.

Get a good lawyer and you both should be fine. Hopefully he's telling the truth about the credit card and everything else.

Yeah - the police department isn't much of a mystery when you list the intersection ;). I'm near(ish) there as well - just off Chamblee-Tucker near Spaghetti Junction.

Well now you know that:

1.) Trespassing will get you thrown in jail.

2.) Not returning property that doesn't belong to you will get you thrown in jail.

You still seem to be in denial because you state in your thread title you "So i got in trouble, for taking pictures" which is not the reason, and you know it.

That story reeks of bullshit.... absolute bullshit. Not to mention that he cops didn't have a probable cause or line of sight to search your car.

Yeah, it's been closed for a couple of months. It's about 2 minutes from my house. My son (who is 4) is so disappointed. :D It was a cool place.

Search incident to a lawful arrest.

Search incident is intended to prevent destruction of evidence/access to weapons... hardly justifiable for misdemeanor / loitering.

It grows out of the inherent necessities of the situation at the time of the arrest. But there must be something more in the way of necessity than merely a lawful arrest.

In other words, you can't arrest someone on a vague charge and then execute a warrantless search in order to find a real charge.

Man, if you're going to trespass you don't park your car there. You park and walk or have someone drop you off.
