I loved that truck...had alot of plans for it. Just bought a service manual for it last week even...that's still coming in the mail.

The complex is at fault. Same as if a tree from my porp. came up and hit something on your prop. S__T happens, thats what insurance is for.

But worse case take more pictures of the roots and SAVE everything. Just in case you can go to small claims court. And don't forget this is give and take. So ask for at least 50% more than the truck is worth to YOU. So if you could have sold it for 3K ask for 4.5K. Tell them that is to help get what ever you get back in order, maintaince etc.... That way you are more likely to get something fair.

Update: They admitted fault. Kinda. They admitted that they wanted that area next to the tree clear, but did not know that the landscaping company cut the roots of the tree to do so. So they are trying to pin it on the landscapers. Their insurance folks still haven't come yet. But everything is fully documented and I don't think I will have a problem with the case. Such a huge hassle though.

They should be covering a rental while the vehicles out of commission too (until they cut you a check). I'd let them know you are going to be getting one. If you want it.

This is why you should always have at least Comp added to your insurance. That way deer, baseball bats, keys, trees, hail, would be covered. Comp is so incredibly inexpensive.

Probably not necessary, but, gets things to move quicker when there is a $20-30 a day tab potentially building up. Just the mention of it might help.

Heh, don't see why anyone would want to live in CA with rates like that. Me and GF pay 130 a month for full coverage on 4 vehicles. We don't have any tickets though.

Update 1/6: They will pay me for it. Now is just a question of how much. I am in the process of gathering together documentation from nadaguides.com and autotrader.com to figure out a general price. Then adding on the price of my new tires and rims and the 2" lift. I will ask them for $4300 which I think is fair replacement value.

They told me that the whole thing is very complicated. The tree was on city property, but the landscapers messed up and cut its roots, so there are two insurance companies involved. I told him that it's not my problem, and I just wanted their insurance company to pay me out first. Then they can do whatever they want with the other parties involved, which he agreed.

Update 1/15: The property owner made me a private offer to buy the truck as-is from me for $2500. I told him that won't work and did not accept the offer. In the autotrader, I looked for 89 Toyota trucks within a 100mile radius. The cheapest one was $2000 and the most expensive was $6800, with the average $4000. I made a counter offer and told them $3800 would be the lowest i'd accept. I'll take it to court if i have to. This is ridiculous....

They just upped the offer to $3000. I am considering this offer. I told them if it's $3000, then I get to keep my brand new tires/rims for my new truck. I will get back with them tomorrow....what do you guys think? Fair?

if you keep those rims and tires i think it would be fair. assuming the value of that is 800 or so

the value of my rims and tires are about $400... i just want them so i can put them on my replacement truck when i get it. otherwise i'd have to spend more money then...

I'd say take it. Your tires and rims wouldn't have been covered on insurance unless you pay extra. They don't increase value because of upgrades unless you pay extra on top off full coverage. If they give you the rims and tires, Id go for it in a minute
