Trashpicking: Theft or Not?

I just gotta know after reading some of the opinions in the Neil Armstrong/Barbershop thread:

You bought a new refrigerator.
You leave your old fridge by the curb for the trash man to collect.
The fridge is collected by someone else before the trash man can come.

Would you consider the fridge to have been stolen?

If I was famous I would. Somebody would take my refridgerator and then sell it as "DAINBRAMAGED'S REFRIDGERATOR!!!! TAKEN FROM HIS CURB!!! NO RESERVE!!"

of course not. Better to have somebody take it and make it work than for it to take up space in a landfill.

nah. someone took our old BBQ from the curb on large item pickup day last fall. i was glad someone could still get some use out of it.

because you already left it outside meaning you were going to throw it out anyway. If it was in your home and then someone took it, I would say theft

Hell no. I expect it, actually. I've tossed some stuff that had no use for me and I didn't feel like carting to Goodwill and I know somebody got it before the garbage men did.

Really the answer depends on whether or not there are any children inside, because then it would be kidnapping, not theft.

No, it's my liquid nitrogen food cooling unit.

Then it would be illegal disposal of human remains and you would be hauled before a magistrate for not recycling.
