Traffic tickets: If the officer doesn't show at the court hearing...

... you won't always get off without a penalty. My friend Kat learned the the hard way today. I felt bad, because I directed her to that website that is meant to help you get out of tickets/fines as soon as she got the ticket... and she followed everything to a tee, but was still charged.

"Verdict: GUILTY AS CHARGED!

The San Diego Court system does not take driving in excess of 100mph lightly. I learned that quickly as the first woman to talk to the judge was sentenced $371 and her license suspended for one month (she had to hand over her license to the bailiff on the spot).

So, there I am...sweating, shaking and contemplating about how my life would SUCK without a license for a month when the second group to talk to the judge is called up. Low and behold my name is among those called.

"Miss Glancy, you are being charged for allegedly speeding 100 miles an hour but, that is not what you were cited for. Says here that you are being cited for exceeding the 65 mile per hour speed limit. You are not eligible for traffic school but, your license is NOT in jeopardy..."

CHA CHING!!!!! I still must pay the $371 ($30 of which is added because I can not pay the amount in full today) and this offense goes on my record. The latter is what I was dreading the MOST.

This is the lesson I have learned. I will not drive 100mph anymore, especially on Labor Day.

Also, in San Diego County if you plead not guilty your arreignment is rescheduled to a time when the accusing officer is available to defend his/her accusation. So, as far as if the officer doesn't show up, then you're off...doesn't apply. ::sobs::"

Just an FYI/heads up to others who may be in a similar situation. Speeding is bad.

She probably plead guilty or no contest. Because if she had plead not guilty then she would have had to come back later with the citing officer there.

Sorry if this wasn't clear enough... the above was written by my friend Kat, who was the unfortunate (yet guilty) party involved. I'm not sure about the details, but I'll ask her. I guess all the evidence they had was the ticket, which was apparently enough.

EDIT: Or what Staley8 said above.
 
Wow, i've always beat ALL my tickets by just showing up, while the cop didn't. But i only had 1 speeding ticket, 1 ticket without wearing a seatbelt, and 1 ticket with wrong plates on my car.

In Georgia (at least in Dekalb county in Atlanta) if the cop doesn't show up, they reschedule the court date. No getting out of that way here.

Well the wrong plate is a long story. I was suppose to register the plates i had on, and deactive another set of plates. But i got them mixed up or something... damn, i don't even remember, it's been so long, but it was pretty confusing for me at the time too.

As for the seatbelt, i always wear a seatbelt, i was just careless that time. I had just come out of a coffeeshop, and was carrying 2 coffees. I was trying to be careful of not spilling them in the car, that i was paying too much attention to the coffee while i drove off and simply forgot. Funny thing is though, the coffeeshop was only like 5 blocks from my house.
 
Speeding isn't bad; getting caught is bad 🙂 Most people who would come down on her for 100 will probably go 80 themselves, so it's all just worse, but quantifiably worse, not qualifiably worse. You can go 150 mph on a public road, for all I care, as long as nobody is around. Have fun!

hehe going that fast inst a capitol offense here, but i thought if you were in excess of the speed limit by 30mph or more the officer could arrest you on the spot for wreckless driving.....😕

Looks like you have lots of money going out, between this and Las Vegas...my condolances. Tickets suck...with no tickets in 3 years, I've gotten 2 in the past 3 months. bah.

2. I'm not going to Vegas this weekend after all... trying to curb my addictive gambling personality.
 
The I-5 is notorious for having speeders going 100+. I was one of them and got tagged by Oceanside PD a few years back. 102mph.


You should double check with your friend and have her get a H6 report from DMV. In excess of 100+ will most likely result in a "wreckless driving" offense on her DMV record, which most insurance companies will find it equavalent or a bit lower than a DUI charge.

Congrats on the butt saving, but I really don't think anyone has any business driving over 90 mph.

I believe driving in excess of 100 mph is a felony no?
