So a lawyer said that a married couple can easily avoid all ticket given out by traffic cameras.

The gist of it was that you register your car in your spouses name and their car in your name.

When you get a ticket in the mail, it is of the car but the person who is driving the car is not the registered owner. All the registered owner has to do is prove that it wasn't them. Now, since the other driver was their spouse, they cannot be compelled to disclose the other drivers identity.

Thoughts?

In NC the ticket is a non-moving ticket. It is treated like a parking ticket. So the ticket is for the car, not the person. As such the owner has to pay the fine.

That’s when you plead the 5th, spousal privilege, attorney privilege, etc… and also state that by asserting only one of you many legal rights would violate not only your rights but maybe someone else’s. That and it’s the States job to PROVE their case. At least that is how it’s supposed to be.

And you think they are that dumb? If your car ha snot been stolen and you simply say it was not me, then they are just gonna ask, "so, who did you loan the car too...".

If you plead the 5thm I'd imagine the next step would be investigating it on their own. I mean...your wife and you do share the same address.....

How much would they get from a ticket to warrant an investigation?

If you live in AZ use a PO box for your car's registration.
If a ticket comes to the PO box, just ignore it.
They aren't (currently) having process servers track down people's addresses.

Red Light cameras are an affront to our liberty and violate the constitution. Freemen do not comply with unconstitutional laws or devices for they are the tools of the tyrant.
 
I can't believe I'm agreeing with either Patranus or spidey07 on something, but both speed cameras and red light cameras should be illegal. They're run by private companies looking to maximize profits, so they retime traffic lights to shorten the yellow which allows them to send out more tickets, but also cause more accidents. Yay!

Thankfully in Michigan, both ARE illegal. And yet, our accident rates are lower. So much for that whole "they promote safety" idea. They promote tickets, that's all.

But yes, the scenario in which you register each other's car is absolutely correct. They send a photo along with the ticket, you just say "that's obviously not me driving" and that's the end of it. They cannot force you to answer questions about who it is. They are a private company, not the police after all.

And for those with the "Just don't speed then!" responses, spare me. Find me one person driving the speed limit on a highway, and that is the one person causing traffic problems. Speed isn't the danger, its the variations in speed that cause accidents, so when one person is driving 50 while everyone else is going 75, that's dangerous.

Where did I advocate running red light/speeding?
Where did I advocate avoiding personal responsibility?

I posed something I head and asked with the forums thoughts were on this "legal theory".

I didn't take a position one way or another on the subject.

Yea, I don't agree with either of them two very often, but this is one case where I agree 100% too. It's one thing when traffic laws are enforced specifically for "safety" (Examples: DUIs, and pursuing people who are driving without insurance)

It's something completely different when they are not improving saftey, and their focus is on revenue instead, often in some cases revenue being the only motive.

Also, Speed limits should be set appropriately to the 80 percentile speed.... then, they won't be such a joke, and maybe people will obey them. The way they are now, they are stupid, lots of roads are set to 55 or 65 with most drivers cruising around 80-85mph....
