Towbin Infiniti denies auction winner of an 03 G35 coupe...

Here ya go:

Hi I'm new here to NASIOC and was writing in hopes of some advice from the gentleman who had the battle before with ebay on his car.

I have recently won an auction on ebay for a G35 Coupe
from Towbin Infiniti in Las Vegas, Nevada.

I won the car for $23600 and was getting ready to have my financing done when the salesman told me he would not sell for that price and refused the ebay auction.

I don't know what to do now and was hoping that the last guy could give me some advice. Please e-mail me at civic4982@hotmail.com or post here any advice you may have. Thank you kindly in advance. I really hope that this ordeal isn't as drawn out as his became.

Towbin is about to feel the full wrath of the nerd Force. :D

I love how they seem to think their TOS somehow overrides the Ebay TOS. :laugh:

How old is the G35 he bid on (eBay is also blocked from work!)?

I guess since it's still a fairly new model, it would be a good value for $23.6K even if it were relatively old.

It's a 2003.

The guy just posted that they sold the car to someone else and offered him a different one at a higher price. :shocked:

Those guys have balls!

UPDATE:

The car I won is now sold to someone else and the dealership had the audacity to call me and tell me they had another car if I was interested but not at that price.

It's a 2003 w/just under 27K miles.

Ok, according to their TOS, there is no where that states as the VP of the company claims... that they can refuse a bid, even AFTER the auction has closed. I think the other site got confused by the statement "Bid Retractions
Bid retractions are not allowed nor will be recognized within 12 hours of auctions end. Seller will not be obligated to sell in the event of a late retraction." what they are saying is that if someone retracts a bid and the auction ends, they are not going to honor the next lower bid.

Ebay will not do anything... after all, this is the seller's property and it is the sellers to do with as they please, until money changes hands... it sucks and is definately not right, but the most Ebay will do is either give the seller a warning, or suspend the account.

We reserve the right to cancel all bids and end an auction early should the vehicle no longer be available for sale.

The dealership screwed up as they should have set a reserve or canceled the auction. The auction did not end early so I hope the guy gets his car.

that car looks so badass in blue.

This guy will probably have a hassle to get it, but in the end, he will definitely win the car. eBay is a contract, and he has every right to get the car that he won fair and square.
