TORONTO - Individuals who share personal copies of music files on the internet are safe after a Federal Court rejected a motion on Wednesday that would have allowed the music industry to sue them.

On Tuesday, the recording industry sent warning letters or filed charges against 247 people in Denmark, Germany, Italy and Canada.

When do you download from kazaa, who initiates the transfer? You see, here its legal for me to borrow a cd from a friend, copy it, return it and then keep my copy. Its why blank media is expensive.

So according to this definition, to breach copyright law, I'd have to send someone a music file, not download one myself.

If I have files on my computer thats my business. I am not liable to see to it that noone else has access to those files. If someone accesses my computer and copies a file I am not liable for that. They are the ones copying it.
If I access someone elses computer and copy on of their files I have no way of knowing what that file is. It could be named anything and often files are misleadingly named. Now after I download the file if it is a song I expect any songs that are copyrighted to have a notice. If there is no notice then how am I to know of the copyright holders wishes? So if there is no notice I have no way of knowing what copyright limitations exist for the song. Therefore I cannot be held responsible for copying it.

So you can't get busted in Canada for selling drugs so long as the addict takes the drugs from your hand? Because the drugs were just sitting in your hand and they took them after you took the money that was just sitting in their hand.

I support the idea of file sharing music because it's non-violent protest of the monopolies the music industry has and the outrageous prices and lousy quality of the music they put out, but only as a clandestine activity...never did I think a rational person would think this was legal.

You can get "free" healthcare, by letting your 7 year old niece operate on you...but do you WANT that?

This only applies to copyright. Companies may not like it, but consumers don't like getting ripped off on media either (just a few months ago they increased the levy's on HD based mp3 players).

Healthcare is for citizens and legal immigrants, but its universal not free.
