THIS GUY!! What to do with this ebaying idiot?! ...and paypal's stupid policies...

Okay, i bought THIS on ebay. I sent payment on February 11th through Paypal. A couple days after i sent payment, i asked him if it was sent, and he said yes. I later found out that it wasn't postmarked until the 27th of February, when it finally arrived March 10th. Anyways, there were scratches on the unit and the headphone jack did not work. When i told him the problems, he responded:

hello eric so now another complaint/// the unit is fine and we are liquidators and dont do refunds and will not . we looked at the unit here and it it fine and have pics here and at this point will report you to ebay ... we did nothing wrong and will not trannsact with you any more on anything we will go to ebay with these invalid reports

I followed up with:

So far i believe my complaints have been justified. Here's a list of WHY i complained, just in case you could not follow along previously:

1) I sent payment on February 11th. I expected the unit to be shipped out the same week, which in this case, was FIVE WORKING DAYS. It did not happen. I asked you a few days after i sent payment, and on February 14th, you replied with, ".hi yes it was last week should be soon keep an eye" which i later found out was a complete LIE. The package was postmarked on the 27th, a full 2 weeks after i had paid for the unit.

2) The unit's headphone jack does not work. This contradicts your item's description, "kept very well dont see no problems not scratched up and had it on working ...so it's nice" The unit has scratches on the turning dials and the face plate. I would understand scratches during shipment, but the types of scratches on the turning dials were not related to shipping. Secondly, a broken headphone jack does not constitute as "no problems."

3) "the unit is fine and we are liquidators and dont do refunds and will not," you have said. Too bad none of this was mentioned on the auction. Point being, i could care less if you were the President of the USA, i want my money back. Keep your excuses, i could care less.

4) "at this point will report you to ebay ... we did nothing wrong and will not trannsact with you any more on anything we will go to ebay with these invalid reports," you state again. Report me to ebay? That's quite laughable. And "did nothing wrong?" There are many things wrong, as i have written above. And if there will be no transactions between us--mainly you sending me back a full refund, there won't be much of a problem. My transactions will take place with Paypal (by taking money from YOUR ACCOUNT), who will gladly refund my purchase, thanks to the buyer protection policies. Sweet, isn't it? You see, the request of a refund isn't much of request at all, at this point, it's much much more like an ultimatum. If you do not understand what i've stated above, please reply and ask for a simple explanation, i'll gladly oblige to help.

What are the chances that paypal will give me a refund?
 
thanks to paypal's new policy, do the following things (in this order)

give the seller a neg
report him to ebay
send the headphone's back w/tracking
get your refund
 
That freaking sucks. I have never bought anything on eBay nor from FS/FT. Most transactions go well, but the opportunity to cheat (both buyers and sellers) is simply too large of a risk for me to take.

Only if you purchased the optional Buyers Insurance... (that is my guess)

I don't remember there being a Buyer's Insurance when i paid for it. I think that was enacted after the 11th, doh!

Keep your cool, and attack. See how your simple question resulted in his THREATENING response? He is trying to intimidate you. First of all, that POS can't even spell so i wonder how professional his 'liquidation' business is. Second, if he is a legit business, that is great news for you. You can really fvck the guy over if you find the company name, you can a) report it to the better biz bureau, at which point he will want to, most likely, settle with you - it aint' worth bad rep for $46 dollars. or b) you can threaten litigation, and it will never get to that point... he will settle, c) you can also report it to the secretary of state or contact them to try to determine who is running the show.

In either case, I'd fight this tooth and nail if i were you.

Bet it sounds damned good too! Anyways, i just got off the phone with the PAYPAL csr and i'm not happy. I had opened up a Buyer Complaint complaining to ebay about the non-shipment. Since it almost took a month for the unit to arrive, i thought he was yanking my leg, so i filed for one. When it actually came, i had to cancel that complaint. BUT, the problem now is that you can only have ONE complaint per EACH transaction!!

WHAT THE HELL IS THAT LOAD OF CRAP?! The csr told me there was nothing else to do and i accepted it--was i being too calm? Should i have erupted in fury, asking to speak to her manager? One complaint per each transaction is sooooo utterly retarrdddeeeedd!!

And i'm checking with ebay. They've referred me to Squaretrade, would that get me anywhere if the Paypal thing falls through?

And negative feedback will force the company to do anything? If they truly are liquidators, they DONT' want a bad report filed with the BBB, no business wants that. While a bad report will certainly tarnish their rep. in Ebayland, in the real world, filing with the BBB will be more effective. I would advise he does both.

i have filled twice with the BBB. Nothing was done either time. all they do is write them letters and thats it. One company actually laughed at me when i told them i was reporting them. It was a waste of time.

Of course giving the company a negitive feedback means you will get one in return.
 
I haven't seen that receiver since the 80s. Man, that thing is a classic! 🙂

I hope you nail this scum. I can stand dishonest people.

Hey, I meant for you to call THE SELLER, not PayPal..

Call the chamber of commerce in his city and report him (many ebay sellers are possibly violating some laws in their city/state if they sell more than a certain amount of stuff without getting a dealers license)
Call the BBB in his city and report him
Call Paypal back and speak to a manager and let them know you need to file a complaint of some kind or you will file a complaint with your bank or credit card you use with paypal??
 
Paypal doesn't get involved when the merchandise isn't received as described.
I got a Pentium 233 Dell laptop instead of the PII 300 Dell laptop that was described
on an Ebay auction.

Filed a claim with paypal and they said "sorry, we don't guarantee the condition of items
you purchase but only that the seller has shipped you something".

So the way I understand it, the guy could have shipped me a brick and as long as he
could prove with a UPS tracking number that it was left at my house paypal is satisified.

Paypal sucks the big one......me and them are splitting the blanket as they say!

Sorry dude, Paypal is not going to refund your money. As long as the seller shipped it they have no power over the transaction anymore. I had to learn the hard way 🙁
