Think I have a chance of getting this dropped?

I sold a moving truck a few months back. Got cash for it, signed the title over that day to the buyer. A couple months go by, and I get a call - it seems that the truck was STOLEN, and I need to come down and file a police report. Turns out, the moron never went to the DMV and had the title put in his name. Fvck. So I go down, file the report, etc. This was sometime in October, I think.

Fast forward to today. I get a summons in the mail for an ABANDONED VEHICLE registered in my name. I look at the ticket, sure enough, it's that GD truck again. :roll: Apparently the thieves tired of it or something. Anyway, the summons REQUIRES me to appear in court in March (fvcking great, perfect way to spend a vacation day from work). The ticket says it's up to a $1000 fine.

My housemate, who is an NYC cop, called his department and says that there's no record of a police report being filed. Awesome. :roll: The only thing I can think of is that it MAYBE got filed under the name of the idiot who bought the truck and caused all these problems in the first place. I still have to get in touch with him and see if he has any of that paperwork.

I do have a bill of sale with the VIN# on it, that was signed and dated by myself and the buyer. That's about all. It's bad enough that I have to go to court for this bullsh!t, but if I have to pay for it, I'm going to seriously kill somebody. :|:|:|:|:|:|

Anyone else have experiences similar to this? Or know more about the legal proceedings?

Well, that's sort of what I thought...I'm just worrying that it won't hold up for some unforeseen reason. Dumber things have happened in the courts....

That, and I'm freaking pissed I have to go in there. I'm actually looking for another job, and this crap is almost 2 full months away :(. WTF happens if I get another job, move away, and am gone by then? AAAAGH.

I've been reading the ticket - there is a way to do that. In fact, that is probably what I'll end up doing. I'd have to submit any documentation that I'd like considered as evidence. I'll know more once I get in touch with this guy - if he can get ahold of that paperwork from when the theft was reported, I'll try to get the incident # from it. Maybe even get the guy to mail me a photocopy of the signed-over title.

Then, I have to prepare a statement, swear it in front of a Notary Public, and send all that crap in. By the time I get that done with, it'll probably be pretty close to March anyways. :|

Make sure to keep the original bill of sale and send in a copy.

It would be all you need for the original to get lost in the mail or something.

Good call. Although I'm not sure if they would require the original? I may call them tomorrow or Monday and see what the requirements would be for that.

In CA we have a release of liability form which protects you from liability in case of
accidents, tickets, etc. The seller needs to do this and shouldn't presume the
buyer will get insurance/register the vehicle, etc.

I actually received a notice about a ticket for a car I sold and when I went
to the DMV, the person told me to fill it out and submit it asap and back date it...date
in which I sold the car.

It worked for me in CA but NY - not sure

3. Put lien on truck for expenses incurred.
4. Claim truck for your own.
5. Sell truck.
6. Profit.

I would assume they have something like that here...hindsight is 20/20, I guess. That's something I'll certainly be looking into though. Thanks for the information...

Lol...well, if he doesn't cooperate, and I do somehow end up paying for it...that's something I'll seriously consider doing. Although, this thing was costing me a fortune just to store it when I had it.

And, people were seXing in it in the middle of the night when nobody was looking. :Q

Hell, I wouldn't even mention that it'd been previously reported as stolen.

Go to court, "your honor, I sold this vehicle to XXX a few months ago. Here is the dated and signed bill of sale"

I had it parked in a public lot for a while. I kept the back door unlocked and the box empty, so stupid thieves wouldn't break the latch to get in. I started finding used condoms in the back and on the ground around the truck when I would check on it a couple times a week. :eek: I made a thread about it here, but am too lazy to find it.

You could send in a notarized copy (i.e. get a notary to sign and stamp a copy)

I didn't read through this, so I'm not sure if I'm the first to say it, but if your housemate is a NYC cop, ask him for christ's sake. He'll be able to give infinitely more reliable info than anyone here can.
