It's amazing anyone gets convicted anymore. Nothing is anyone's fault, after all (other than big businesses).

The dissenting justices agreed that insulin-induced hypoglycemia could result in involuntary intoxication but said Garcia's low blood sugar was a result of his own actions. He had injected himself with a large dose of insulin on the day of the attack in anticipation of eating cake and ice cream at his daughter's birthday party.


So much for 'involuntary.'

Uh, yeah, it can. It's called hypoglycemic shock, and the symptoms are almost identical to inebriation.

edit: hmmm. I remember an awful piranha movie from the late 70's early 80's where the water had something in it that made everyone hypoglycemic except the two protagonists who were drinking out of an office cooler. They finally get a handle on the fish problem, but just as they are about to lick it, the hypoglycemic sherriff shows up and blows them away, roll credits. Apparently it wasn't Piranha though by the IMDB's description.

yeah, i'm a type 1 diabetic myself, and i wanted to kill this woman working a concession stand who was being slow giving me a soda when i had low blood sugar

Granted, he could've gone into hypoglycemic shock, but they key thing here is he did it to himself. This is just more red tape they have to go through before he gets convicted.

So, if my girlfriend makes me a large dinner and I overeat, can I get off on the defense that all the blood rushed to my stomach for digestion, leaving me disoriented and confused? I then hit her on the head with a gravy boat until she cried uncle? Hmm... may have to try this next Thanksgiving.
