she broke the law.

you can't just pick and choose the laws you want to obey...

Like I said, since it was illegal for her to have that gun in the glove box, she had the right to remain silent regarding the weapon.

It was her fault that she confessed to breaking the law to a police officer.

It is extreme, but gun owners should be well aware of the possible implications of carrying across state lines.
Gun owners should be well aware to stay the fuck out of New Jersey, where the only people allowed to be armed are in government and/or the Mafia.

Gun laws you should be pretty well aware of if you own a gun.
See my previous post about going to N.C.

And +1 for staying out of N.J. Wasn't there a similar story last year about a guy traveling through, called in advance to find out how to carry and he still got busted?

does punishment fit crime?

you have to look at intent.

I don't even own a gun. I commute to NJ every day for work.

My problem is exactly this. It doesn't seem like this lady is trying to go shoot up a mall or something. It's a fact that not all law enforcement officers know every fact of the laws they are tasked with enforcing. While I do agree the woman should have known the gun laws better in NJ if she was bringing a gun there, was it that unreasonable for her to think she was in the clear because she does have a concealed carry permit issued by Pennsylvania? I say no. And it's not like she was lying and being evasive. From all appearances, and I know we were not there, it seemed like she was trying to comply with the law and law enforcement officers.

I think the NJ gun carrying laws are draconian and excessive. No way does the potential punishment fit the crime. Just like the punishment did not fit the crime in the Brian Aitken case which was 7 years until it got commuted. Aitken got 7 years even though his guns were locked, unloaded, and stored in the trunk of the car.

shouldn't all you gun / death penalty supporters be arguing that the harsh penalties are used as a deterrent?

When they fit the crime.

Yeah but that's not the intent of the law. The intent of the law is to throw as many black people in jail as possible, and on that front, the law is a stunning success. Before passing strict gun laws, only black criminals could be thrown in jail. After passing strict gun laws, black business owners and black professionals could be thrown in jail as well.
