but i sent maxtor a 7200rpm drive and they send back a 5400rpm in its place?

Yes, either you gave them the wrong information or they sent you the wrong drive. Maxtor made a mistake, it's not their normal policy. I'm sure they'd be glad to replace it.

However, you may have orginally sent them a 5400, thinking it was 7200 (like you bought it from a website claiming it was 7200, but they actually shipped a 5400 without you knowing). In this case, I don't think they are obligated to give you a 7200.

Their policy is that it will be replaced with the same or better drive. They may try to tell you that the 5400RPM drive is newer and better than the old one, and that is possible. The actuators could be faster for the seeks, however the rotational latency will definitely be higher, so overall the seeks may be equal or slower on the new drive. If the new drive has a much higher data density, then throughput COULD be faster than the old drive, because more data passes under the head with each turn, so it could make up for the lower speed. However I'd say that you got gipped overall.

dam it might have been a 5400 RPM. It was in a external USB enclosure. Any one know if there evan was a 7200Rpm external USB drive?

Doubtful that it was a 7200RPM. USB is so slow there's no point to putting a louder, hotter drive into it. You have any model numbers or anything? (Since you'd have to give that to Maxtor to get the RMA.)
