What is Prop2?

God I am going to be so sick tomorrow when this passes. I find way too many people supporting this, and when I ask why, they still don't have a real answer. I feel it affects NO ONE, and they are just being the authoritarians they wish to be...

Please let TX suprise me...................[crickets]

Anyway, it will be funny if some lawyer takes this section to court:
(b) This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage.

I would agree. The state needs to get out of recognizing any legal status identical or similar to marriage.

Ironic if people in Texas in a rush to ban gay marriages, end up banning ALL state recognized marriages. :)

You are not going to be surprised. It will pass no problems. Even thought there has been no coverage on the issue to speak of, I have seen only one ad about it in the last few months, everyone I know knows about it. They all have either voted or will vote tomorrow. And yes, everyone I know will vote for Prop 2, and no they don't have to have a reason that is to your liking. The turnout for an odd year local only election will be interesting.

Note that there's a paragraph within this statute that implies that the Texas legislature believes that there are legal options available to non-marrieds that can provide all of the legal protections provided by marriage:
This state recognizes that through the designation of guardians, the appointment of agents, and the use of private contracts, persons may adequately and properly appoint guardians and arrange rights relating to hospital visitation, property, and the entitlement to proceeds of life insurance policies without the existence of any legal status identical or similar to marriage.
The problem with this is that there are other rights provided by marriage that cannot be obtained in any other way. For example, the privileged status of marital communications means that a person cannot be compelled to testify against his or her spouse regarding what the spouse wrote or said. Such a protection would not be available to non-married couples in Texas.

But I have no doubt that this and all of the other states' constitutional amendments barring gay marriage are going to end up in the supreme court.

This is a State's rights issue. The bond of marriage is granted by the state, not the Federal Government. Why do you think JPs say "by the powers vested in me by the state of......" as they complete the ceremony? The Supreme Court has no say, only the Supreme Court of the state in question and they are not going to go against something an overwhelming majority are agianst (gay marriage) whenever it shows up on a ballot.....with a few regional exceptions.

I think that this single line contained in the bill will be the downfall of it when it gets challanged for constitutionality:

(b) This state or a political subdivision of this state may not create or recognize any legal status identical or similar to marriage.

If that isn't clear cut discrimination, I don't know what is. That should be enough to be overthrown under the "Equal Protection" rights granted to all citizens. The wording here essentially makes gays second-class citizens.

Maybe DonVito (or someone else with a law background) can help me out on this.....if this passes and is then overturned in court, would that basically make gay marriage legal in Texas by virtue of statute?

personally i don't give a f*ck what a church does as long as they don't invade my government. and why, are you going to miss your tax break/penalty? I'd just start my own church and marry anone who wanted to be... ;)

Well, as far as I can tell they aren't really banning gay marriage. They're just defining marriage as between a man and women. This is the same thing that North Dakota did last year. Basically, they're just going around the definition of discrimination, but in reality it is discrimination. Hopefully, the next generation of Americans won't be so bigoted.

I fear you're right. I know 4 votes against it (me, my brother, my g/f, and a friend), however I know of millions for it. This is truly depressing.

Actually it is, if it wasn't you wouldn't see many states rushing to curb the problem before it becomes a bigger mess. The overwhelming majority of people are against gay marriage, it shows whenever the issue is voted on. This country has always been based on majority rule so if you do not like it there are plenty of extremely liberal countries you can move to....I hear France takes in just about anyone.
