A super conservative Texas federal judge has declared today, that the Texas law placing a minimum age of 21 to carry a firearm, as a violation of the second amendment and thus unconstitutional. The judge claims that nothing in the second amendment, talks about a minimum age or any age at all.


Something tells me that something bad is going to start happening Texas. Abott keeps saying that he is making Texas safer. I personally do not think allowing underaged kids carrying handguns makes Texas safer.

I think that "a super conservative Texas federal judge" should be removed from the bench as at least one of his rulings would endanger the lives of everyone.

Well...he's right. There's absolutely NOTHING in the US Constitution that forbids firearms in the hands of minors...does it make good sense? Fuck no...

I'll just wait for the uptick in shootings by minors in Tex-Ass. (not that it doesn't already happen, especially in...gang related shit)

Which means it falls to the legislative branch, federal of state (most likely state). If age not being specified in the constitution, means there can be no age restrictions, then we have thousands of laws on the books that are unconstitutional starting with the age of majority (the age of adult hood, which is actually left up to the individual states to set, where most have them set at 18), as there is no mention of age of majority in the constitution. In fact the only age restrictions in the constitution, that I am aware of, are for voting (age of 18), House (age of 25), Senate (age 30), and President (age 35). I think this judge and many other's are forgetting the purpose of the legislative branch (federal and state), and the powers the constitution grants them.

Actually, the right to restrict age to 18 years of age, may fall under the 26th amendment:

Twenty-Sixth Amendment

Section 1
The right of citizens of the United States, who are eighteen years of age or older, to vote shall not be denied or abridged by the United States or by any State on account of age.

Section 2
The Congress shall have power to enforce this article by appropriate legislation. <--------- here

Well, considering this is a federal ruling, I am sure we can expect this to nation wide soon. At some point I think the executives are going to have to just start ignoring bullshit court rulings. This new interpretation of the Second amendment is just complete horse shit.

There is an extreme irony in the fact that a state, trying to protect itself and its citizens, is not allowed to do that due to the 2nd amendment.

The irony being that the 2nd was supposed to allow the states to protect themselves.

I’ve said it before and I’ll say it again; democracy enforced by a gun is not democracy, its authoritarianism.

These idiot right wingers and gun nutters are creating a self fulfilling prophecy.

The definite article seems to make it a collective entity. Does that mean you all get to share guns between you and decide among yourselves who gets to pull the trigger? And does "the people" include toddlers?

The Framers really should have put more effort into being precise about how they worded things.

LOL that article talking about Uvalde parents holding a rally at the state capitol pushing for making rifle purchases illegal for those under 21 when Uvalde is a rightwing town that voted for this extremist shit. The nazi trump won by 22 points there in 2020.

Naw man, Texas saw how those civil wars in Africa featured pre-teen and adolescent children armed with AK's and RPG's running around all over the place killing each other because they were from different factions and said "Now this is how a militia was meant to be because the Constitution never said it couldn't be that way."

Unfortunately, they anticipated their legislative descendants would be reasonable people, but, they are far from it.
