Texas Senate Approves Bill To Allow Gov. Greg Abbott To Overturn Elections​

The GOP-controlled body's unprecedented move focuses on Houston's Harris County.

The GOP-controlled Texas Senate on Tuesday passed a proposal allowing the state to overturn elections in Harris County, home to the state’s most populous city Houston.
The legislation penalizes county officials for running out of ballot paper at some voting sites in the 2022 election, the Houston Chronicle reported. Still, more importantly, it gives Republican Gov. Greg Abbott “precedent-setting” power to undo election results.
The measure would give Abbott’s appointed secretary of state the authority to hold a new election in the county if it runs out of paper at 2% or more of its polling sites for more than an hour, the newspaper noted.

The bill’s Republican co-author, state Sen. Mayes Middleton, said, “There is no excuse why we can’t competently run our elections and have adequate ballot paper.”

But Senate Democrats saw the move as simply handing the governor a way to reverse results as Republicans like former President Donald Trump and losing Arizona governor candidate Kari Lake tried to do.

Harris County, which once skewed Republican, voted nearly 56% Democratic in the last presidential election. Abbott and U.S. Sen. Ted Cruz lost the county in recent re-election races, the Chron noted.
“You want to vest in a political appointee the ability to make a decision as to whether or not an election should be overturned and reheld?” state Sen. Royce West (D-Dallas) said.

Harris County Attorney Christian Menefee told the Chron that the bill was “about targeting the largest county in the state, which is led by people of color.”
County Commissioner Adrian Garcia said it was a form of “election denial.”

The bill now goes to the Republican-controlled Texas House.

Middleton said the shortage “stopped countless people from voting on election day,” Fox 26 reported.

But a Houston Chronicle study concluded that the paper shortage did not alter the outcome of the elections in Harris County, defying Republican claims of voter suppression in GOP-leaning areas. There was “no evidence voters were systematically disenfranchised,” according to the study.
Abbott had previously said the paper shortage would “necessitate new laws” directed at Harris County, Newsweek reported.

How in the world do they justify a law directed against only one county? Apparently other (read GOP dominated) counties can continue to run out of paper ballots without any blowback?

BTW this is a relatively common problem everywhere that uses paper ballots. For security purposes they have to be printed on certain paper and tracked carefully and are quite expensive. Here in CT we had sporadic outages in both the 2016 and 2020 election, primarily because voter turnout greatly exceeded expectations/historical trends.

Hell, TX got nothing on GA. In GA, the Repub legislature passed a quaint law allowing the Gov to replace the election committee of up to 4 counties per election cycle if he believes the county “underperformed.”

The Gov gets to hand pick the replacements.

Why is this bad? Hand picked election committee and their power to certify elections.

No one has explained what underperforming means, obviously.

They’re targeting the ATL area, overwhelmingly liberal, black, and an affront to “them.”

It reads like another voter suppression measure to me. If you re-do an election, you're more likely to get a conservative result because old people have more time to vote. I can't imagine why the GQP would want that!

How on earth you run out of paper ballots is beyond me. You literally know the maximum number of people who can legitimately show up, and you print that many ballots. That would be playing it very safe, considering the history of voter turnout in that county. Paying it extremely safe would be adding a buffer percentage in case of x number of voters accidentally spoiling their ballots. Instead these guys are legislating some very slippery-slope powers. I can't imagine why fascists would want to do that!

So to avoid this heinous crime from occurring the democrats need to make sure they have enough paper for everyone to vote. This seems like something they should be good at.

Indeed, in select precincts, they often have extra paper available in case it is needed.

Ever stop to ask why the legislature would give the governor such a power?

It seems awfully naive to think that this is being done with anything close to good intentions. It is worse than just voter suppression, it is granting the ability to overturn an election - even if only for a subset of people. To anyone remotely interested in democracy, this should be horrifying.

Additional voter suppression by Republicans. People don't want their policies, so they rig the vote. Of course, this is Harris County which is the most diverse in the state.

Was thinking, are democracies not doomed to fail? If democracies succeed on a broader scale are people not bound to forget that the alternative is worse - and in the process willingly sign over all the individual rights they have accumulated over time?

Seems to me this is what's happening in some places right now.

It was always gonna end in a shit show.

Just let them have the country, at this point. Maybe it will temporarily cool their bloodlust and we can have some quiet before this planet inevitably melts anyway.

Debatable. The Nazi efforts to exterminate the disabled were not pursued as enthusiastically as with their other targets for genocide - because there was such a massive outcry from ordinary Germans, including some Nazi-supporters. No such outcry occurred with regard to other groups, such as Jewish people or gypsies or gay people.

The fact that the popular resistance to the idea caused the Nazis to officially drop that part of the Holocaust prematurely perhaps says something about the culpability of ordinary Germans with regard to the fates of those other groups.

Someone like Abott might have have survived the whole thing.
